Robust Bayesian nonlinear mixed‐effects modeling of time to positivity in tuberculosis trials

Early phase 2 tuberculosis (TB) trials are conducted to characterize the early bactericidal activity (EBA) of anti‐TB drugs. The EBA of anti‐TB drugs has conventionally been calculated as the rate of decline in colony forming unit (CFU) count during the first 14 days of treatment. The measurement of CFU count, however, is expensive and prone to contamination. Alternatively to CFU count, time to positivity (TTP), which is a potential biomarker for long‐term efficacy of anti‐TB drugs, can be used to characterize EBA. The current Bayesian nonlinear mixed‐effects (NLME) regression model for TTP data, however, lacks robustness to gross outliers that often are present in the data. The conventional way of handling such outliers involves their identification by visual inspection and subsequent exclusion from the analysis. However, this process can be questioned because of its subjective nature. For this reason, we fitted robust versions of the Bayesian nonlinear mixed‐effects regression model to a wide range of TTP datasets. The performance of the explored models was assessed through model comparison statistics and a simulation study. We conclude that fitting a robust model to TTP data obviates the need for explicit identification and subsequent “deletion” of outliers but ensures that gross outliers exert no undue influence on model fits. We recommend that the current practice of fitting conventional normal theory models be abandoned in favor of fitting robust models to TTP data.     

民汉双语诉讼规则之探索

我国宪法赋予了公民用自己的民族语言文字参加诉讼的权利，目的在于实现民族平等、促进民族团结、禁止民族分裂、保护中华民族语言文化的多样性，进而提高我国的文化软实力。通过调查民族语言文字诉讼司法实务，发现当前存在着少数民族语言文字诉讼程序混乱、不符合诉讼原理等问题，不利于民族语言文字诉讼权利的实现。究其原因，在于该诉讼制度缺乏程序保障。为了确保民族语言文字诉讼权利的有效实现，应设立“民汉双语诉讼规则”，以为司法机关提供统一的操作规范。民汉双语诉讼规则应该明确民汉双语诉讼的概念、类型以及民族语言文字诉讼权利的内容，并且根据不同诉讼类型有针对性地设置审判语言与诉讼语言的适用规则。     

杜甫亲情诗的情感特征和情感渊源

杜甫的亲情诗不仅数量多，而且颇有个性色彩，其情感的广阔性、深重性、真挚性非常鲜明。这一特色的形成，一方面是因为杜甫深受儒家文化尤其是儒家传统伦理道德观的影响，另一方面，也与其漂泊的人生经历和每况愈下的健康状况有关。     

Eros in the field? Bourdieu's double account of socialized desire

In his later works, Bourdieu draws extensively on psychoanalytic approaches in accounting for his concept of socialized subjectivity as bound to the social world by an intense affective grip. This emotional turn holds potential for further developing Bourdieu's account of subjectivity as a formation of socialized desire. However, in accounting for this socialized desire, Bourdieu relapses into a dualism of subjective and objective structures, incompatible with the Merleau‐Pontyian roots of his practice theory. Tracing this problem to the antagonism between desire and culture in the psychoanalytic accounts that Bourdieu draws on, I propose that the psychoanalytic scholar Hans Loewald's account of Eros may enable a move beyond this impasse, offering a promising conceptual basis for taking further the account of socialized subjectivity and socialized desire in Bourdieu's practice theory.     

论行政处罚法上的便宜原则

便宜原则在我国行政处罚法上并无明文的依据,但在行政实务中却不乏采用。基于合理行政的要求,在行政处罚法上应当承认便宜原则。便宜原则作为法定原则的一种补充,应仅于特殊情形下适用。由于便宜原则授予了行政机关更加宽泛的自由裁量权,因此其在适用时必须受到严格的约束。在将来修订行政处罚法时,有必要对便宜原则作出明确的规定。

关于《红楼梦》中《警幻仙姑赋》的争议历来颇多。它与曹植的《洛神赋》在文字表达等方面有太多相似之处。从挖掘《洛神赋》背后的深意入手,可最终得出这样的结论：对残酷现实的情感宣泄以及人生理想的幻灭是曹雪芹效仿《洛神赋》的根本目的,更是创作《警幻仙姑赋》的深层动机;同时《警幻仙姑赋》在体裁选择及写作手法上所体现出的＂师楚＂情结,也使《警幻仙姑赋》的悲剧意味得以进一步延伸和升华。     

网络文学版权保护探析

侵犯网络文学著作权尤其是信息网络传播权的现象在当下十分严重。侵权的模式包括"云霄阁模式"和"百度模式"。它的背后既体现了社会公众、网络服务提供者和版权人之间的利益平衡,也是互联网精神、权利意识和商业模式三者博弈的结果。解决侵犯网络文学版权的问题需要注重培育公众正确的互联网意识、完善法律制度建设、创新文学网站的盈利模式及大力发挥社会组织的作用。保护网络文学著作权对创新虚拟社会管理有重要意义。     

Social capital of entrepreneurs in a developing country: The effect of gender on access to and requests for resources

This paper addresses gender differences in the social capital of entrepreneurs in a developing country. Social networks are often an important asset for accessing resources; however, they may also be a liability in developing countries, since entrepreneurs are often expected to support their contacts. Using a recent survey among urban and rural Ugandan entrepreneurs, we focus on the financial resources that entrepreneurs can obtain from their contacts on the one hand, and requests for financial support made to the entrepreneurs from these contacts on the other hand. Our results show that there are gender differences associated with access to, and requests for, financial resources.     

地方高校学困生帮扶现状分析及对策

深入贯彻落实十九大精神，打赢教育战线上的脱贫攻坚战，实施帮扶确保学业困难学生顺利完成学业是每一位教育工作者义不容辞的责任。文章采取问卷调查和访谈相结合的方法对SL学院400名学业困难学生帮扶现状进行了调查，结果显示：学困生帮扶意愿强烈，倾向于向朋辈求助；学困生认为学校已经开展的帮扶很有必要，但效果有待于进一步提高；辅导员作为学校学困生帮扶的主要人员，对学生的帮扶深度不够，效果欠佳，亟待提出相应对策提升帮扶效果，帮助学困生顺利脱困。     

Establishing Laws and Policies on Parent to Child Violence in Finland 1965–1983

This study explores perceptions of parent to child violence, the arguments for imposing legal regulation, and the intended objectives of the legislative process that led to a ban in Finland in 1983. This qualitative policy analysis examines policy documents alongside expert interviews with professional on the legislative process. The example of Finland shows that a significant change in attitudes and decreased levels of violence towards children can be achieved without the threat of legal punishment, even without specific intervention policies. However, the study emphasises the importance of establishing clear practices alongside altering legislation which has been inadequate in Finland.
