Zusammenfassung  Rechtsansprüche gegen Fluggesellschaften und Flugzeughersteller in Folge einer Flugzeugkatastrophe richten sich nach einer Flut rechtlicher Bestimmungen, die aus internationalen Abkommen, Vereinbarungen zwischen Fluglinien sowie aus Bundes- und Landesrecht resultieren. Die jeweilige Rechtsgrundlage in einem spezifischen Fall h?ngt von verschiedenen Umst?nden ab, die mit einem Unfall verbunden sind. Es überrascht daher nicht, dass zugesprochene Schadensersatz- und Schmerzensgeldzahlungen an die Angeh?rigen der Opfer von Fall zu Fall erheblich divergieren. In unserer Studie mit U.S.-amerikanischen Daten untersuchen wir, inwieweit der kurz- und langfristige Erfolg von Fluggesellschaften und Flugzeugherstellern durch Flugzeugkatastrophen beeinflusst wird und wir eruieren diejenigen Determinanten, die Performanceunterschiede erkl?ren k?nnen. Verwandte Untersuchungen haben sich weitgehend auf Effekte für Markennamen oder steigende Versicherungspr?mien als Ursachen für Aktienkursverluste konzentriert. Unsere Ergebnisse zeigen darüber hinaus, dass das regulatorische Umfeld einer spezifischen Unglückssituation erheblichen Einfluss darauf hat, wie Finanzm?rkte reagieren. Die Reaktionen der Marktteilnehmer weisen darauf hin, dass die unterschiedlichen Berechnungsgrundlagen für die Opferentsch?digung recht klar erkannt werden.
The role of aviation laws and legal liability in airplane accidents: A financial market perspective
Summary  Legal liability claims against airlines and airplane manufacturers following an aviation disaster are determined through a myriad of international treaties, intercarrier agreements, and federal and state laws. Which law applies in a specific situation depends on various circumstances surrounding the accident. As a result, pecuniary and non-pecuniary damage awards for the families of the accident victims may vary substantially from case to case. Using U.S. data, our study examines how aviation disasters affect the short and long-term performance of airlines and airplane manufacturers and explores the factors that drive the performance differences. While prior research has largely focused on brand name effects and rising insurance premiums as possible determinants of stock price losses, our results suggest that the regulatory environment that applies to a given aviation accident has a significant impact on how the market reacts to its announcement. Inequities in the valuation of a human life are clearly reflected in stock price reactions. While recent regime changes have helped eliminate some of these imbalances further reform may be necessary.

Effective risk communication is an integral part of responding to terrorism, but until recently, there has been very little pre‐event communication in a European context to provide advice to the public on how to protect themselves during an attack. Following terrorist attacks involving mass shootings in Paris, France, in November 2015, the U.K. National Police Chiefs’ Council released a Stay Safe film and leaflet that advises the public to “run,” “hide,” and “tell” in the event of a firearms or weapons attack. However, other countries, including Denmark, do not provide preparedness information of this kind, in large part because of concern about scaring the public. In this survey experiment, 3,003 U.K. and Danish participants were randomly assigned to one of three conditions: no information, a leaflet intervention, and a film intervention to examine the impact of “Run, Hide, Tell” advice on perceptions about terrorism, the security services, and intended responses to a hypothetical terrorist firearms attack. Results demonstrate important benefits of pre‐event communication in relation to enhancing trust, encouraging protective health behaviors, and discouraging potentially dangerous actions. However, these findings also suggest that future communications should address perceived response costs and target specific problem behaviors. Cross‐national similarities in response suggest this advice is suitable for adaptation in other countries.  相似文献

U.S. airports and airliners are prime terrorist targets. Not only do the facilities and equipment represent high‐value assets, but the fear and dread that is spread by such attacks can have tremendous effects on the U.S. economy. This article presents the methodology, data, and estimates of the macroeconomic impacts stemming from behavioral responses to a simulated terrorist attack on a U.S. airport and on a domestic airliner. The analysis is based on risk‐perception surveys of these two scenarios. The responses relate to reduced demand for airline travel, shifts to other modes, spending on nontravel items, and savings of potential travel expenditures by U.S. resident passengers considering flying domestic routes. We translate these responses to individual spending categories and feed these direct impact results into a computable general equilibrium (CGE) model of the U.S. economy to ascertain the indirect and total impacts on both the airline industry and the economy as a whole. Overall, the estimated impacts on GDP of both types of attacks exceed $10B. We find that the behavioral economic impacts are almost an order of magnitude higher than the ordinary business interruption impacts for the airliner attack and nearly two orders of magnitude higher for the airport attack. The results are robust to sensitivity tests on the travel behavior of U.S. residents in response to terrorism.  相似文献

The extreme importance of critical infrastructures to modern society is widely recognized. These infrastructures are complex and interdependent. Protecting the critical infrastructures from terrorism presents an enormous challenge. Recognizing that society cannot afford the costs associated with absolute protection, it is necessary to identify and prioritize the vulnerabilities in these infrastructures. This article presents a methodology for the identification and prioritization of vulnerabilities in infrastructures. We model the infrastructures as interconnected digraphs and employ graph theory to identify the candidate vulnerable scenarios. These scenarios are screened for the susceptibility of their elements to a terrorist attack, and a prioritized list of vulnerabilities is produced. The prioritization methodology is based on multiattribute utility theory. The impact of losing infrastructure services is evaluated using a value tree that reflects the perceptions and values of the decisionmaker and the relevant stakeholders. These results, which are conditional on a specified threat, are provided to the decisionmaker for use in risk management. The methodology is illustrated through the presentation of a portion of the analysis conducted on the campus of the Massachusetts Institute of Technology.  相似文献

Research on the risk of motor vehicle injuries and their relationship with the amount of travel has been only partially analyzed. The few individual exposure assessments are related to very specific subsets of the driving and traveling populations. This study analyzes the relationship between kilometers traveled and hospitalization due to motor vehicle injuries. Twelve thousand three hundred and sixty nine Spanish university graduates from the Seguimiento Universidad de Navarra multipurpose cohort study were evaluated. They had not been hospitalized due to motor vehicle injuries at baseline and were followed up to eight years. Biannual questionnaires allowed for self‐reporting of kilometers traveled in motor vehicles, together with incidence of hospitalization. Covariates in the Cox regression models included age and gender and baseline use of safety belt while driving, driving a vehicle with driver‐side airbag, driving a motorcycle, and drinking and driving. There were 49,766 participant‐years with an average yearly travel of 7,828 km per person‐year. Thirty‐six subjects reported a first hospitalization event during this time. The adjusted hazard ratio per additional kilometer traveled was 1.00005 (95% confidence interval 1.000013 to 1.000086). Even the smallest of reductions in the amount of kilometers traveled (from an average of 3,250 km per year to 1,000) has a statistically significant protective effect on the likelihood of sustaining hospitalization due to motor vehicle injury (aHR 0.9, 95% CI 0.78 to 0.98). In light of current policies aimed to reduce motorized traffic due to environmental concerns, it may be appropriate to consider the additional health benefit related to reductions in injuries.  相似文献

How people leave a devastated area after a disaster is critical to understanding their ability to cope with risks they face while evacuating. Knowledge of their needs for communications about these risks is particularly crucial in planning for emergency responses. A convenience sample of 1,444 persons who survived the World Trade Center (WTC) attacks on September 11, 2001 were surveyed to ascertain their initial and ultimate destinations once they had left the buildings, how they arrived there, the role of types of obstacles they encountered, and the need for information and the seeking of other people as potential factors in influencing the process of leaving immediately. This survey was part of a larger, original survey. Results showed differences in how people traveled by mode to initial and ultimate destinations, how immediately they left the area, and factors associated with when they left. How they traveled and when they left were associated with where people lived, their tendency in times of stress to seek out other people including who they knew in the immediate area (e.g., co‐workers or friends), the physical conditions surrounding them, and the importance to some of waiting for more information. Many people indicated they did not leave immediately because they had no information about where to go or what services would be available to them. Perceptions and communications about risks they were facing were reflected in the choices they considered in how and when to leave the area. These findings have numerous ramifications for understanding and guiding personal behavior in catastrophic situations.  相似文献

The Abu Sayyaf is an organization which has left a trail of mayhem and murder in the southern Philippines for more than a decade. It has gained international notoriety through several high profile mass kidnappings. This article looks at how the Abu Sayyaf has managed to survive and at times prosper despite the state's efforts to eradicate it. By using organizational analysis the paper demonstrates how the Abu Sayyaf has developed structures and processes which make it such a deadly force. We critically examine the accepted notion that primary education is a legitimate and necessary function of the state. The notion is based upon three tenets: 1) public education is a necessary condition for democracy, 2) the market will not provide equal access and quality of education to all, and 3) education represents an external economy. Each tenet is addressed and evaluated according to its merits. In doing so, we also contrast the fulfillment of the ends implicit in the tenets under state and market provisions. We conclude that the state provision of primary education cannot be justified by these goals, and that market provision is a preferable alternative.
