在跨国移民理论框架下认识中国的“外籍新娘”

越来越多的“外籍新娘”嫁入中国,“外籍新娘”出现在许多媒体和新闻报道中。学术界使用的“外籍新娘”、“跨国流动人口”、“外籍流动人口”等概念都不能准确描述因婚姻流入中国的外籍女性流而不动的情形。研究者将这类现象视为跨国婚姻或女性的跨国流动,但不能准确分析已经在中国长期定居的跨国婚姻女性人群的移民事实。笔者认为在跨国移民理论框架下认识中国的“外籍新娘”,她们已经具备了“国际移民”定义的基本特征。这些女性像所有移徙到世界任何国家的移民一样,是“跨国移民”。因相关移民法律政策缺失,这些来自亚洲国家的女性婚姻移民一直难以取得合法身份而滞留中国,成为事实上的“非正规移民”,对中国当前的移民政策提出新挑战。     

Changing economic conditions and their effects on professional autonomy: An analysis of family practitioners and oncologists

This study examines the effects of dimensions of the social structure on professional autonomy. Little support exists for arguments suggesting professional dominance or professional-bureaucratic confrontation. The study supports a theory of social change that places physicians in their historical, political, and economic context. There are four important findings. First, the degree of autonomy varies across physician specializations, and the social structure affects the autonomy of family practitioners and oncologists in different ways. Second, the Federal Drug Administration constrains the responsibility autonomy of both oncologists and family practitioners, and the innovative autonomy of family practitioners. Third, bureaucracy either has no effect or enhances physicians' autonomy. The fourth, and most consistent, finding demonstrates that profit-seeking corporations external to the work setting constrain physicians' autonomy. Findings suggest that researchers should give more attention to shifts in the loci of power and the effects of organizations external to the work setting, especially corporations, on professions.An earlier draft of this paper was presented at the American Sociological Association annual meeting, Miami, Florida, August 1993.     

Beyond Nation-State Paradigms: Globalization,Sociology, and the Challenge of Transnational Studies

Globalization has made it increasingly necessary to break with nation-state centered analysis in macrosociologies. Social structure is becoming transnationalized, and an epistemological shift is required in concurrence with this ontological change. A new interdisciplinary transnational studies should be predicated on a paradigmatic shift in the focus of social inquiry from the nation-state as the basic unit of analysis to the global system as the appropriate unit. Sociology's fundamental contribution to a transnational studies should be the study oftransnational social structure. This article does not establish a new transnational paradigm. Rather, it surveys and critiques nation-state-centrism in extant paradigms, provides a rationale for a new transnational approach, and proposes a research curriculum of a new transnational studies that may contribute to paradigmatic reconceptualization.     

跨国公司内部化理论的发展脉络与扩展——市场、优势内部化与内部混合市场

市场内部化和优势内部化是跨国公司内部化理论的两个主要分支，它们分别关注跨国经营过程中节约交易费用和利用无形资产特有优势的外部收益。近年来由企业跨国联盟、虚拟网络和非股权合作催生出跨国公司合作网络与内部混合市场，这是内部化理论的第三个分支。通过对三个分支理论所反映的企业替代市场、价值增值、合作载体等有关企业本质认识发展的分析，可以理清内部化理论的发展脉络并重构其分析框架。

针对跨国零售滥用市场优势地位越来越严重的情况,近年来我国采取了积极的规制措施,并主要集中于法律规制、行政规制等几个方面。但是,跨国零售依然以各种方式滥用市场优势地位,零供矛盾没有得到彻底解决。为了增强规制效果,建议增强《反垄断法》的实效性,制定统一的《零售商供应商公平交易法》,发挥行业协会等非政府组织的积极作用。

对李维时代罗马的万民法、战争法、随军祭司法以及三者关系的研究,可以展现罗马私法以外的罗马跨民族关系公法.罗马人民的跨民族法包括神法和人法两个方面,随军祭司法属于前者,它主要调整以誓言的遵守为核心的战和事务;万民法和战争法属于后者.在这个意义上的万民法是使节地位法,涉及使节不受侵犯原则、使节不得实施敌对行为原则、侵害使节的后果、使节于战时在敌邦的居留权等问题;战争法则关涉战时对敌人的人身和财产的处置权.

全球阶级和跨国国家问题是近年来全球化研究中值得关注的热点问题之一。美国学者威廉·罗宾逊的《全球资本主义》一书,在依据马克思关于资本循环理论对资本主义生产方式的全球扩张进行分析的基础上,较系统地提出了关于全球阶级和跨国国家的理论,尽管其中一些观点还不够透彻,但对我们深入探讨全球化背景下的阶级斗争和国家问题仍具有重要的启示意义。     

跨国社会运动动员的限制性因素分析——以全球替代运动为例

作为跨国社会运动,全球替代运动的跨国动员存在诸多限制,空间距离、心理距离以及政治机会这些因素都会影响到其跨国动员的效果。为了实现在全球层面的跨国动员,全球替代运动一方面采取网络抗议、社会论坛、新议题建构等方式来克服运动实践中空间距离与心理距离所带来的各种障碍,另一方面,还灵活运用国际社会与国内社会所提供的双重政治机会,规避政治机会因素对全球替代运动跨国动员的限制。
