新中国工伤保险制度六十年的发展变迁

工伤保险制度作为历史最为悠久和最为普遍的保险项目之一,在中华人民共和国成立之初即得以确立.六十年来,中国工伤保险制度虽历经挫折,却在调整与改革中不断前进:公平的价值取向得以确立,政府责任逐渐回归,并逐渐由被动反应走向主动参与,各方利益主体也在向着更加和谐、健康的关系发展.但改革仍在继续,随着"以人为本"理念的深入,"最大限度地保障劳动者权益"将成为中国工伤保险制度的最终目标.     

The value of employment for people living with spinal cord injury in Norway

The purpose of this article is to examine the value of employment for people living with spinal cord injury in Norway. The main focus in the 31 interviews dealt with general perceptions of integration and participation. The value of employment was a major theme, primarily described by the participants in terms of personal and social identity in interaction with others, as a hegemonic social norm and a sense of moral obligation to contribute to society. The value of meaningful regular jobs – in contrast to government projects jobs or routine jobs – was emphasized.     

Effects of Impact-Absorbing Flooring in Residential Care from the Perspectives of Enrolled Nurses

Falls are a daily occurrence in nursing homes and few interventions for reducing fall-related injuries have proven to be effective. Impact absorbing flooring (IAF) in residential care has shown promising results in reducing fall-injuries and in the process of developing and implementing IAF all aspects are valuable to explore. Therefore, the aim of this qualitative study is to describe the enrolled nurses (ENs) experiences of IAF. We carried out focus group interviews with ENs and used content analysis to process the data. The ENs experienced both negative and positive aspects with the IAF. Importantly, the ENs perceived the IAF as effective in preventing fall-injuries. They also appreciated the improvements in acoustics. Negative aspects were that the flooring initially was challenging to walk on and that it made it harder to maneuver heavy equipment. A significant and transferable finding in this study was the importance of the ENs' perceived difficulty in preventing fall-injuries amongst elderly people living in nursing homes. This seemed to be a driving force to accept the intervention. Although IAF affects the working conditions in a nursing home, ENs are willing to accept these issues given the perceived effectiveness of the intervention.     

论医疗行为造成医疗损害的范围

医疗损害是医疗行为对患者所造成的人身伤害、财产损失、精神痛苦以及对患者隐私权和名誉权的侵害,是医疗行为所引起的对患者方造成的不利后果和事实。因此,应当以《民法通则》、《医疗事故处理条例》以及相关的法规的规定,进一步界定和明确医疗损害的范围,从而客观、公正地解决因医疗行为引起的医疗损害纠纷。     

学生伤害事故中学校民事责任分析

学校不是未成年学生的监护人,但对学生的人身安全及健康负有安全关照义务,学校违反该义务致使学生受到伤害,应承担侵权的民事责任.学校对学生伤害事故主要负过错责任,在特殊情况下还要承担无过错责任甚至公平责任.对学校过错责任的认定标准只能是客观标准.<学生伤害事故处理办法>的某些规定有不妥之处,其中与民事法律相悖的内容应当无效.     

略论高校学生伤害事故及其防范

目前,关于未成年人在学校的伤害事故已备受社会各界的关注,然而,关于高校学生的校园伤害事故的研究却依然是一个空白。对高校学生伤害事故的类型、特点及责任认定进行全面的分析,有利于高校建立有效的学生伤害事故防范体系。     

精神损害赔偿中国亟需立法

精神损害赔偿是民法中的一个重大理论问题,也是近几年的热点问题,本文在分析国外有关立法的基础上,着重对我国精神损害赔偿的侵权客体的范围、精神损害赔偿的范围、精神损害赔偿请求主体的范围、精神损害赔偿侵权责任方式及精神损害赔偿归责原则等方面的立法缺陷进行了较为深入的探讨,并提出了较具体的立法建议。     

Recognition of Nonverbal Communication of Affect Following Traumatic Brain Injury

Recognition of facial expressions and vocal prosody was examined using the Diagnostic Assessment of Nonverbal Accuracy 2 (DANVA-2) and the Carolina Older Adult Test of Nonverbal Communication (COAT-NC) for 24 individuals with traumatic brain injury (TBI) and 24 matched controls. Results demonstrated that participants without TBI scored significantly higher than participants with TBI when presented with adult photo and voice stimuli. No significant group difference was noted with child photo and voice stimuli. Both groups scored significantly higher on photo subtests than on voice subtests for child and younger adult stimuli. For older adult stimuli, both groups scored significantly higher on the voice subtest than on the photo subtest. For the subjects with TBI, a significant relationship was found between scores on the voice subtests and a functional measure of cognition and communication.
