Jus Primae Noctis or Droit du Seigneur

Jus Primae Noctis (Right of the first Night) was a subject of much interest and considerable controversy in the nineteenth and early twentieth centuries. Scholars debated whether it was a custom, a right, or even a myth. Recent evidence would emphasize the so‐called right was simply the ability of the powerful to subject the less powerful to their will. Rape might be a better term to apply since husbands and families had to resort to subterfuge to thwart the desires of the powerful.

作为一种古老的犯罪,强奸罪在内地和我国台湾地区各有不同的立法方式。近年来海峡两岸关于本罪主体的立法都出现了变化。立法的变化是对社会现实的适时反应,同时不同的性文化观念也对此产生了重要影响。女子可以成为本罪的直接实行犯,内地立法应对此做出相应规定。     

战时日本当局在国内是如何封锁南京大屠杀真相的?

近年来,日本右翼势力抓住战时日本国内新闻传媒对南京大屠杀无任何报道、日本广大民众更一无所知大做文章,以此证明南京大屠杀史无其事,乃是远东国际军事法庭的编造与中国人民的"虚构"。这当然是本末倒置!本文揭示了战时日本当局在日本国内精心采取的种种措施,千方百计阻止与扼杀对南京大屠杀的任何报道与流传,从而严密封锁了南京大屠杀真相,导致了广大日本民众对这一血腥惨案几乎一无所知。日本右翼势力不能正视甚至掩盖这一历史事实,只能暴露他们的的蛮横无理与别有用心。

婚内强奸一直以来是困扰理论界和司法实务界的一大难题。对此,人们可谓仁者见仁,智者见智,但并未达成一致意见。作者拟从婚内强奸的理论争鸣着手,探究其法理原因,并结合中国的现状,提出适合中国本土的婚内强奸的立法建议。     

WEAPONS OF SEX,WEAPONS OF WAR

Recent international attention has focused on designations of rape and sexual violence in conflict zones. The most formative debates on this issue centre on the 1990s-era conflicts in the former Yugoslavia and Rwanda, which also involved heated debates amongst feminists over designations of rape as genocide. While the International Criminal Tribunal for Rwanda case, the Prosecutor v. Akayesu, resulted in the first formal charge of wartime rape as genocide within international criminal law, the first case to charge wartime rape as genocidal occurred in US federal court. This project looks for the overarching social and political meaning of the contemporary international legal focus on rape and sexual violence. It examines why, how, and to what extent US and transnational feminist legal academics and activists transmitted and secured their understandings of the relationships between sex, violence and ethno-religious difference within the international legal arena. In doing so, I argue that their participation in the contemporary recognition and narration of sexual injury in a global context both retreads and reconfigures the heated 1980s-era US Sex Wars debates on the workings of gender, sex, race and power.

Tracing the Life of a Crime Category

This article traces the shifting meaning of “date rape” in US newspapers across a fourteen-year period. A crime category created by a niche feminist press, “date rape” originally referred to a form of intimate-partner violence, and has, more latterly, come to refer predominantly to an assault that occurs after a victim has had a drug, such as Rohypnol, surreptitiously slipped into her drink. Employing quantitative content analysis to explicate this shift, the article considers possible explanations for the changing meaning of “date rape,” including the applicability of the risk thesis and criminological theory on the de-politicisation of crime. Finally, I suggest that a feminist perspective allows us to recognise that “date rape” has been transformed from an issue of female disempowerment into a nebulous threat of limited ideological significance.

运用混合线性模型的分析原理 ,对 1 996年和 1 997年的四川省油菜区域试验的产量结果 (非平衡数据 )进行统计分析。结果表明 ,影响油菜产量的随机效应方差分量中 ,年份—试点互作方差分量最大 ,表明 9个试点的产量表现在1 996年和 1 997年很不一致。多重比较分析表明 ,绵阳 92 -4 592和 94 0 7N比对照中油 82 1增产达极显著水平 ,这与线性对比分析结果相似。据回归参数和置信区间判断 94杂 -4稳定性较好     

Factors Affecting College Students' Perceptions of Sexual Relationships Between High School Students and Teachers

ABSTRACT

This study explored the effects of respondent gender, gender combination (male teacher/female student versus female teacher/male student), and teacher age (24 versus 39-years-old) on the perception of a sexual relationship between a teacher and a 16-year-old student. Participants were 80 male and 80 female undergraduates. A MANOVA yielded significant main effects for respondent gender and gender combination. Subsequent ANOVAs indicated that men generally viewed the experience more positively and that the male teacher/female student combination was viewed more negatively than the female teacher/male student pairing.     

“They Are All Good Boys”

This paper analyzes the construction of incidents of gang rape in Israeli newspapers between the years 2000 and 2010. The study examines the differences between the news media framing of gang rape and individual rape. Results indicate that the coverage of gang rape significantly differs from that of individual rape. Newspaper coverage over-emphasizes instances of gang rape in relation to individual occurrences of rape by means of sensational headlines and “yellow” journalism. Moreover, the construction of gang rape reflects a convergence of gender, race, and class oppression through the blaming and marginalizing of victims, criminalizing rapists from socially marginal groups, and absolving offenders most closely associated with the upper middle class. These findings suggest that the Israeli media play a key role in perpetuating patriarchal hegemony and social inequality.
