试论商业贿赂罪

我国相当长一段时期无商业贿赂罪名的规定，但是在刑法规定的受贿罪、行贿罪中包括了商业贿赂罪。全国人大常委会颁布的《关于惩治违反公司法的犯罪的决定》中第一次明确规定了商业受贿罪。然而我国刑事法律对商业贿赂罪的规定还存在着不足之处，在以后的刑事立法中，应增加能明确区分受贿罪、行贿罪的商业受贿罪、商业行贿罪的概念、构成要件及法定刑的规定，以完善我国的商业贿赂罪的立法。     

女性人口社会保障获得的户籍差异——基于城乡分割与区域分割视角

利用2005年广东省1%人口抽样调查数据,在城乡分割与区域分割的视角下,将女性人口区分为四群体：本地女性市民、本地农村女性、外来女性市民和外来农村女性。分析了不同户籍身份女性人口获得基本社会保险差异的基本情况,并通过logistic回归分析了社会保险获得的影响因素。

The immigration–crime relationship: Evidence across US metropolitan areas

Despite popular commentary claiming a link between immigration and crime, empirical research exploring this relationship is sparse. Especially missing from the literature on immigration and crime is a consideration of how immigration affects rates of crime at the macro-level. Although individual-level studies of immigrant criminality and victimization tend to demonstrate that immigrants typically engage in less crime than their native-born counterparts, the effect of immigration on aggregate criminal offending is less clear. In this research, we attempt to address this weakness in the literature by examining the effects of aspects of immigration on crime rates in metropolitan areas. We combine 2000 US Census data and 2000 Uniform Crime Report data to explore how the foreign-born population influences criminal offending across a sample of metropolitan areas. After controlling for a host of demographic and economic characteristics, we find that immigration does not increase crime rates, and some aspects of immigration lessen crime in metropolitan areas.     

Penalized image averaging and discrimination with facial and fishery applications

In this paper we use a penalized likelihood approach to image warping in the context of discrimination and averaging. The choice of average image is formulated statistically by minimizing a penalized likelihood, where the likelihood measures the similarity between images after warping and the penalty is a measure of distortion of a warping. The notions of measures of similarity are given in terms of normalized image information. The measures of distortion are landmark based. Thus we use a combination of landmark and normalized image information. The average defined in the paper is also extended by allowing random perturbation of the landmarks. This strategy improves averages for discrimination purposes. We give here real applications from medical and biological areas.

犯罪转化论要

行为具有动态变化属性,具有转化的联系,这决定了犯罪转化的存在空间。行为本体意义上的转化区别于立法层面上的犯罪化和非罪化过程,它是指一种犯罪行为在其发生过程中因某一原因而转化为彼种犯罪并依彼罪定罪量刑的刑法现象。其理论根据在于哲学的事物发展观以及刑法中的犯罪构成界域论。在转化原因论上包括犯罪结果、行为、罪过等多种转化因素,在类型上它又呈现为一幅容单一犯转化与复数犯转化、事中转化与事后转化、事实转化与法定转化为一体的多维转化画面。
