从实务案例出发谈债务加入的认定方式与追偿问题

关于债务加入虽然我国法律上并无明文规定,但自“苏高发审委[2005]16号纪要”首先提出来之后,无论是法学理论上还是法律实务上均成为讨论和应用的热点。笔者以审判实践中遇到的一种特殊情况为出发点,旨在通过争议焦点分析的方式对债权人做出的替保证人还款这一情况应认定为债务加入,并以案例分析的方式系统的展示债务加入的认定方式,并在最后分析了债务加入人履行了债务之后应如何追偿的问题,希望能够作为在实务中分析认定债务加入的有效借鉴。     

The effects of perceived quality of organizationally provided meal service on employees’ job performance and mediating role of organizational identification

Contemporary managers are developing alternative ways to sustain their competitive advantages. Motivation-enhancing features such as high-quality meal service provided by organizations can be thought of as one of these methods. The effect of the perceived quality of meal service provided by organizations on the job performance of employees and the mediating role of organizational identification during this process is studied. Private security-sector employees working in Turkey (N?=?597) are being focused in this study. As a result of analyses (correlation and regression analyses, structural equation model), the authors find that the perceived quality of meal service provided by organizations improves employees’ job performance significantly and organizational identification has a partial mediating role on this association. The findings of this study will be of interest to key stakeholders such as public or private organizations, labor unions and the media.     

Local influence in seemingly unrelated regression model with ridge estimate

Local influence is a well-known method for identifying the influential observations in a dataset and commonly needed in a statistical analysis. In this paper, we study the local influence on the parameters of interest in the seemingly unrelated regression model with ridge estimation, when there exists collinearity among the explanatory variables. We examine two types of perturbation schemes to identify influential observations: the perturbation of variance and the perturbation of individual explanatory variables. Finally, the efficacy of our proposed method is illustrated by analyzing [13 A. Munnell, Why has productivity declined? Productivity and public investment, New Engl. Econ. Rev. (1990), pp. 3–22. [Google Scholar]] productivity dataset.     

Robust modal estimation and variable selection for single-index varying-coefficient models

In this article, we present a new efficient iteration estimation approach based on local modal regression for single-index varying-coefficient models. The resulted estimators are shown to be robust with regardless of outliers and error distributions. The asymptotic properties of the estimators are established under some regularity conditions and a practical modified EM algorithm is proposed for the new method. Moreover, to achieve sparse estimator when there exists irrelevant variables in the index parameters, a variable selection procedure based on SCAD penalty is developed to select significant parametric covariates and the well-known oracle properties are also derived. Finally, some numerical examples with various distributed errors and a real data analysis are conducted to illustrate the validity and feasibility of our proposed method.     

An Adaptive Functional Autoregressive Forecast Model to Predict Electricity Price Curves

We propose an adaptive functional autoregressive (AFAR) forecast model to predict electricity price curves. With time-varying operators, the AFAR model can be safely used in both stationary and nonstationary situations. A closed-form maximum likelihood (ML) estimator is derived under stationarity. The result is further extended for nonstationarity, where the time-dependent operators are adaptively estimated under local homogeneity. We provide theoretical results of the ML estimator and the adaptive estimator. Simulation study illustrates nice finite sample performance of the AFAR modeling. The AFAR model also exhibits a superior accuracy in the forecast exercise of the California electricity daily price curves compared to several alternatives.

执校西南联大的梅贻琦、蒋梦麟、张伯苓是否具有通识教育的理念与认同(尤其是张伯苓是否赞成通识教育),是西南联大史研究中的一个命题。西南联大能够实施通识教育,深层次上的主要原因是居于西南联大最高领导层的"三常委"有着通识教育理念的认同。这种认同,集中体现在:"发展个性,完善人格;健强体魄,担当重任;文理兼融,博通为先;团体协作,消除涣散;陶冶情操,提高素养"五个方面。它表明西南联大要培养具有合理的知识结构与能力结构、品行高尚、判断独立、身体素质良好、情趣丰富高雅、勇于承担社会责任的全面发展的人。西南联大人才培养的成就及其学子的成长体悟,充分说明通识教育是高质人才辈出的重要因素。
