从战略高度切实加强对领导干部的主动监督

本文主要观点是:建立选拔任用干部的监督机制是我国目前亟需解决的重要问题,它关系到是否能将有中国特色的社会主义事业不断推向前关键不是出了问题以后的解决方法,而是要加强对干部的主动监督,防止干部腐败变质.千秋大业在于用人,在选拔干部时应遵循已制定的科学规范,并从几方面加强监督,在工作中不断完善监督机制,同时要强调对干部的教育培训,并将其作为实施监督的基础性工作.     

Local polynomial estimation of Poisson intensities in the presence of reporting delays

Summary.  The system for monitoring suicides in Hong Kong has considerable delays in reporting as the cause of death needs to be determined by a coroner's investigation. However, timely estimates of suicide rates are desirable to assist in the formulation of public health policies. This motivated us to develop a non-parametric procedure to estimate the intensity function of a Poisson process in the presence of reporting delays. We give closed form estimators of the Poisson intensity and the delay distribution, conduct simulation studies to evaluate the method proposed and derive their asymptotic properties. The method proposed is applied to estimate the intensity of suicide in Hong Kong.     

畜产品质量安全监管研究综述

随着经济的发展和社会的进步，畜产品在人们的日常生活中占有越来越重要的地位，目前我国对畜产品质量安全的监管还很不到位。文章总结了我国畜产品安全监管的现状，并介绍了国外畜产品安全监管的现状，通过比较找出我国监管的不足，从而进一步加强我国对畜产品质量安全的监管。     

从部门本位回归到基本理性——对检察机关职权配置的思考

目前,我国法学界对检察机关职权配置问题存在着激烈的争论。争论的主要问题有三个。其中,检察机关是否有侦查权是个伪问题,其本质是检察机关行使侦查权时由谁来监督;检察官不是“中立及超然”的司法人员,不应当有对强制措施的批准权;检察官不应当以居高临下的“法律监督者”的身份监督审判程序,而是应当通过程序动议权和上诉权监督审判程序。目前主张维持检察机关职权现状的学者,有严重的部门本位主义,检察权改革应当摒弃部门本位主义。     

中国民事诉讼费用负担制度的法经济学思考

当事人之间诉讼费用负担和国家对审判成本负担的划分影响着当事人诉讼行为的选择。目前中国民事诉讼费用负担制度存在着制度供给不足、缺少救济措施、权利分布不均衡和国家承担公共成本太低等问题,因此健全中国民事诉讼费用负担制度,制定可行的救济措施,并对民事诉讼费用负担判决实行监督,实施法院独立预算等措施,才是解决民事诉讼费用负担问题的根本途径。     

浅析高校学生管理中的正当程序问题

高校在学生管理过程中侵害学生权益的事件时有发生,诱发高校与学生矛盾的一个主要因素是高校在学生管理工作中的程序瑕疵。在学校的管理工作中坚持正当程序原则,是使学校的管理行为公开、公正、公平的基本保证。在高校学生管理过程中适用正当程序是必然趋势。     

Data skeletons: simultaneous estimation of multiple quantiles for massive streaming datasets with applications to density estimation

We consider the problem of density estimation when the data is in the form of a continuous stream with no fixed length. In this setting, implementations of the usual methods of density estimation such as kernel density estimation are problematic. We propose a method of density estimation for massive datasets that is based upon taking the derivative of a smooth curve that has been fit through a set of quantile estimates. To achieve this, a low-storage, single-pass, sequential method is proposed for simultaneous estimation of multiple quantiles for massive datasets that form the basis of this method of density estimation. For comparison, we also consider a sequential kernel density estimator. The proposed methods are shown through simulation study to perform well and to have several distinct advantages over existing methods.     

An alternative to model selection in ordinary regression

The weaknesses of established model selection procedures based on hypothesis testing and similar criteria are discussed and an alternative based on synthetic (composite) estimation is proposed. It is developed for the problem of prediction in ordinary regression and its properties are explored by simulations for the simple regression. Extensions to a general setting are described and an example with multiple regression is analysed. Arguments are presented against using a selected model for any inferences.     

Issues in applying recent CPMP ‘Points to Consider’ and FDA guidance documents with biostatistical implications

The International Conference on Harmonisation guideline ‘Statistical Principles for Clinical Trials’ was adopted by the Committee for Proprietary Medicinal Products (CPMP) in March 1998, and consequently is operational in Europe. Since then more detailed guidance on selected topics has been issued by the CPMP in the form of ‘Points to Consider’ documents. The intent of these was to give guidance particularly to non‐statistical reviewers within regulatory authorities, although of course they also provide a good source of information for pharmaceutical industry statisticians. In addition, the Food and Drug Administration has recently issued a draft guideline on data monitoring committees. In November 2002 a one‐day discussion forum was held in London by Statisticians in the Pharmaceutical Industry (PSI). The aim of the meeting was to discuss how statisticians were responding to some of the issues covered in these new guidelines, and to document consensus views where they existed. The forum was attended by industry, academic and regulatory statisticians. This paper outlines the questions raised, resulting discussions and consensus views reached. It is clear from the guidelines and discussions at the workshop that the statistical analysis strategy must be planned during the design phase of a clinical trial and carefully documented. Once the study is complete the analysis strategy should be thoughtfully executed and the findings reported. Copyright © 2003 John Wiley & Sons, Ltd.     

完善庭前民事证据交换制度的建议

举证制度关乎民事诉讼程序的公正、高效与否 ,庭前证据交换是举证制度的关键环节。针对我国现行庭前证据交换制度存在的不足与纰漏 ,结合最高人民法院公布的《关于民事诉讼证据的若干规定》 ,从审判实务的角度阐述了完善证据交换制度的一些设想。
