道德建设的三个层面:人性、信仰、哲学信仰

道德是对人现存性的内在超越。具有现实性的人是自然、社会、精神三重属性的统一体。人性于道德有本源意义。人的三重属性是进行低、中、高三层次道德建设的客观根据。根据人性明确道德建设的层次、内容和理由等是道德建设的第一层面。道德建设是在与人性的幽暗面作斗争。因此,仅仅靠认清人性,用以颁布道德律令是远远不够的。社会转型时期的道德建设,必须借助于既基于理性又超越理性的信仰。信仰为解决应然与实然这一道德的根本矛盾给予合理的解释和有效的担保,具有本体的价值。将信仰重构作为道德建设的奠基工程是道德建设的第二层面。凡是道德的必是信仰的,但是并非任何信仰都能成为社会主义道德建设所依助的对象。把马克思主义哲学与中国哲学的精华融为一体的哲学信仰作为社会主义道德建设的精神支柱和理论基础是道德建设的第三层面。     

论友善核心价值观信仰化及其根据

友善是我国社会主义核心价值观体系中最具创新性的概念。友善信仰作为基于内在善意的对他人宽容友好的情感态度以及基于爱心的助人为乐的实践行动相统一的内在德性,知与行相统一并由知而行、实然与应然相统一并由现实而达理想、自觉与自愿相统一并由自觉而达自愿是友善信仰的重要特征。友善既有其现实之物质基础,它是人民根本利益的一致性和由此而带来的人际关系和谐诉求的客观反映,特别是它顺应了新时代人民追求美好生活和人性自我完善的客观必然性;同时,友善还有其我国传统德性主义之文化基因,它在传统文化中有其“仁者,人也”这一以德立人极的本体论根据,有其“君子坦荡荡,小人长戚戚”的价值论依据以及对“和为贵”的处世智慧的传承。友善的现实根据和文化基因的有机融合是其能够被提升为核心价值观并最终为最大多数人所信仰的历史必然。

检察机关职权调整的宪法审视

检察机关的宪法定位由其宪法地位和功能定位构成,《宪法》第3条第3款和第136条是检察机关宪法地位的主要依据,第134条是其功能定位依据。法律监督并非检察机关的专属职权,而是其应尽的义务。“法律监督机关”在整体上指专事维护法制统一和法律秩序稳定的国家机关,检察机关是目前唯一的法律监督机关。检察机关的调整职权应受宪法规范,立法是检察机关职权调整的必由之路,在保留检察机关、固守法律监督的职能定位、不违反宪法基本原则、不侵犯其他国家机关固有职权的前提下,一切国家机关违反宪法和法律的行为均可成为检察机关的监督对象。     

On Order Statistics from Sine Distribution

We derive closed form expressions for the first two moments of order statistics from the sine distribution. For the higher moments, a recurrence relation is given. We also give a recurrence relation for the product moments. These relations will be useful for moment computations based on ordered data.     

The 3 F 2 with Complex Parameters as Generating Function of Discrete Distribution

A new discrete family of probability distributions that are generated by the ₃ F ₂ function with complex parameters is presented. Some of the properties of this new family are studied as well as methods of estimation for its parameters. It affords considerable flexibility of shape which turns the distribution into an appropriate candidate for modeling data that cannot be adequately fitted by classical families with fewer parameters. Finally, three examples in the fields of Agriculture and Education are included in order to show the versatility and utility of this distribution.     

Moment Information for Probability Distributions,Without Solving the Moment Problem. I: Where is the Mode?

How much information does a small number of moments carry about the unknown distribution function? Is it possible to explicitly obtain from these moments some useful information, e.g., about the support, the modality, the general shape, or the tails of a distribution, without going into a detailed numerical solution of the moment problem? In this paper a theoretical result of Johnson and Rogers is generalized to be valid for all moment problems and is exploited to demonstrate that a few moments are able to provide us with valuable information about the position of the mode of an unknown (unimodal) distribution.     

The Beta Product Distribution with Complex Parameters

The family consisting of the distributions of products of two independent beta variables is extended to include cases where some of the parameters are not positive but negative or complex. This “beta product” distribution is expressible as a Meijer G function. An example (from risk theory) where such a distribution arises is given: an infinite sum of products of independent random variables is shown to have a distribution that is the product convolution of a complex-parameter beta product and an independent exponential. The distribution of the infinite sum is a new explicit solution of the stochastic equation X = (in law) B(X + C). Characterizations of some G distributions are also proved.     

Estimation and Prediction for Exponentiated Family of Distributions Based on Records

In this article, a family of distributions, namely the exponentiated family of distributions, is defined and for the unknown parameters, different point estimates are derived based on record statistics. Prediction for future record values is presented from a Bayesian view point. Two numerical examples and a Monte Carlo simulation study are presented to illustrate the results.     

Joint Moment Generating Functions of Nonadjacent Dual Generalized Order Statistics from Reflected Generalized Pareto Distributions

In this article, a class of reflected generalized Pareto distributions (cf. Burkschat et al., 2003 Burkschat , M. , Cramer , E. , Kamps , U. ( 2003 ). Dual generalized order statistics . Metron LXI ( 1 ): 13 – 26 . [Google Scholar]) is considered. Recurrence relations for joint moment generating functions of higher non adjacent dual generalized order statistics based on a random sample drawn from the considered class are derived. Higher joint moments of non adjacent dual generalized order statistics (reversed ordered order statistics and lower k-records as special cases) are obtained. Recurrence relations for single and product moment generating functions and moments of higher non adjacent dual generalized order statistics are derived. Some results of higher moments of non adjacent generalized order statistics from generalized Pareto distributions (cf. Johnson et al., 1995 Johnson , N. L. , Kotz , S. , Balakrishnan , N. ( 1995 ).
