灾疫伦理视域中的气候伦理刍议

伴随全球化进程而出现的灾疫失律,意味着灾疫问题因人类活动的干扰而日益成为一种支配性的内部风险。灾疫失律的一个重要成因,是因人力干扰而造成的包括全球变暖在内的气候危机。不同路径的灾疫伦理研究,可能为气候危机的伦理学考量提供一定的思维契机。灾疫伦理学的生态理性思想,为气候伦理研究提供了一种生态整体视角;气候治理的目标指向,在于创建具有生境化特征的生态文明;气候治理的具体路径,在于践行一种可持续生存式发展的伦理思路。     

气候资源的权力与权利：基于公共财产属性的构造

气候资源不是《宪法》、《物权法》上明确列举的国家所有权客体,也不具有权利客体的特征。气候资源与国家所有权客体在权利归属、表现形态、使用方式、存在目的上存在较大差异,乃是一种公共财产。基于公共信托理论,国家是公共财产的受托人,对气候资源行使诸如气候资源规划权、保护区设立权、纠纷裁决权及开发利用行政许可权等管理权。因为气候资源不是国家所有权客体,源自气候资源国家管理权的民事主体对气候资源开发利用的权利乃是特许物权。气候资源特许物权具有公私兼容的性质,既具有公法性,又具有私法性。     

应对气候变化措施同WTO原则的冲突——理论与实证分析

与贸易有关的环境措施在GATT/WTO法律层面持续引起学者们对贸易与环境问题的激烈争论。而气候变化博弈中,WTO成员方采取应对气候变化的单边措施,可能违反了WTO的非歧视原则和其他若干规则。对从未做出碳减排承诺的国家进口的产品征收反补贴税可能违反SCM协定,TRIPs协定很难成功适用于气候友好型技术的转让与应用之中,这都是气候变化下WTO争端问题凸显的主因。本文通过探讨碳关税等应对气候变化措施与WTO的一致性,对GATT/WTO关于贸易与环境的争端解决案例进行解读,探寻气候变化下WTO争端解决的未来走向,对我国频发的贸易摩擦提出应对策略。     

气候问题的“面相”与“方法”——社会科学视阈下的再思辨

近年来,气候变化问题在社会科学和自然科学研究领域中均引起学者的普遍关注.但因研究领域的分野,社会科学研究和自然科学研究中的气候问题呈现出明显迥异的“面相”.因此,在社会科学领域中,气候变化命题的研究应秉持自身独特的方法论取向.     

论《清洁能源与安全法案》及其对我国气候变化立法的启示

《清洁能源与安全法案》是美国最具革命性和影响力的气候变化法案。该法案共分为五大部分:清洁能源、能源效率、减缓全球变暖污染、转向清洁能源经济以及农业和森林所涉及的抵销。该法案遵循"命令——控制"模式和市场调控模式相结合的立法思路,以气候衍生品作为调节影响气候变化行为的主导工具。我国应当制定《气候变化应对法》,构建碳排放交易体系,以市场机制促进国内碳减排和增加碳汇。我国的气候立法应当减缓与适应并重,分领域有重点地进行气候治理。     

2015年国际原油价格分析与趋势预测

在回顾2014年国际原油市场主要发展历程的基础上,从两方面对2015年油价走势进行了发展态势展望和预测分析。研究认为:受全球经济形势复杂多变,复苏进程缓慢、脆弱而不均衡以及供需基本面因素的主要作用,在产量相对过剩情况下,2015年油价上半年依旧延续下跌趋势,国际原油价格还将在低位震荡,下半年或出现企稳反弹,全年油价波动幅度小于2014年。预计Brent原油均价为50~65美元/桶,WTI原油均价为45~60美元/桶。     

Is demography destiny? The role of structural and demographic factors in Australis past and future labour supply

Following the release of the Intergenerational Report, the Australian Treasury identified the levers to address the economic effects of demographic ageing as ‘the three Ps’: population, participation and productivity. To date, the first ‘P’, population, has been treated as an exogenous factor, with the common view being that there is very little that the government can do to supplant demographic ageing. Focusing upon labour supply, this paper shows how variation in Australia’s underlying demography can significantly alter Australia’s future labour supply. Although governments cannot redirect the cohort flow component of population ageing, much can be achieved in promoting growth of the labour supply by maintaining or increasing fertility (in the longer term), or increasing targeted migration (in the short to medium term). This paper also decomposes the relative role of cohort flow, changing demography and changing labour force participation on the growth of the labour supply over the past 20 years. Over this period, the entry of the baby boom generation (cohort flow) and increased labour force participation of women accounted for almost all of the growth in the labour force. Changing demography had very little effect. However, Australias future labour supply will not include a large increase in cohort flow (as caused by the baby boomers) or a very large increase in female labour force participation. Regardless of the assumptions used, labour supply growth will be considerably lower in the next and subsequent 20 years, when compared to the previous 20.     

A reconstruction of the size and composition of Jewish Holocaust survivors in the Netherlands, 1945

Compared to other countries that have suffered from the Nazioccupation, the destructive impact of the Holocaust on theJewish population has been particularly strong in the Netherlands. This paper gives a demographicreconstruction of the Jewish population in the Netherlands by the end of the war (1945),disaggregated by age and sex. The reconstruction is based on two approaches: a forwardprojection 1941–1945, starting from registration data supplemented by information onHolocaust losses; and a backward projection 1966–1945, starting from an enumerationof Halachic Jews carried out in 1966. The two approaches yieldtwo estimates that are comfortingly similar.     

概念整合网络与新闻漫画的语义构建

文章首先回顾了认知语言学中Fauconnier和Tunner等人提出的概念整合理论的主要概念和基本思想,然后运用这一理论探讨了新闻漫画的语义构建,并选取三副网络新闻漫画进行了个案分析,旨在说明概念整合理论的认知解释力.分析表明,概念整合理论具有解释在线构建非传统意义上的新颖意义的特性,能够为新闻漫画的语义构建、创新和理解提供一个新的理论视角.     

后哥本哈根时代全球气候治理呼唤正义

在国际无政府状态下,气候公共产品必须要靠各国通过合作来集体提供。而要创建应对气候变化的国际合作体系并使其持续有效,就必须以正义为本。为了使人类能够打破目前的气候变化正义悖论,就需要启动一项全球正义工程：通过阐明正义、普及正义和实现正义三步骤来催生气候道德,最终依靠人类自身的改变来逐渐复原已被改变的气候系统。
