美国少年司法变迁中的正当法律程序改革及其借鉴

美国传统少年司法曾经长期不受正当法律程序的约束,这样的特例被认为是为了有利于保证罪错少年获得最有利的处遇。但这样的观念和实践在1967年高尔特案件后开始改变,罪错少年也逐步获得了类似成年罪犯那样的正当法律程序权利的保障。与美国少年司法进行正当法律程序改革之前相似,中国目前对于具有严重不良行为的少年的处置,同样基本上没有任何正当法律程序的保障,这样的状况急需改变。     

Inferences on regression coefficients in a regression model under heteroscedasticity and robustness with respect to departure from normality

In this paper we consider a simple linear regression model under heteroscedasticity and nonnormality. A statistical test for testing the regression coefficient is then derived by assuming normality for the random disturbances and by applying Welch's method. Some Monte Carlo studies are generated for assessing robustness of this test. By combining Tiku's robust procedure with the new test, a robust but more powerful test is developed.     

Construction of Confidence Intervals for the IVIean of a Population Containing Many Zero Values

The likelihood ratio method is used to construct a confidence interval for a population mean when sampling from a population with certain characteristics found in many applications, such as auditing. Specifically, a sample taken from this type of population usually consists of a very large number of zero values, plus a small number of nonzero values that follow some continuous distribution. In this situation, the traditional confidence interval constructed for the population mean is known to be unreliable. This article derives confidence intervals based on the likelihood-ratio-test approach by assuming (1) a normal distribution (normal algorithm) and (2) an exponential distribution (exponential algorithm). Because the error population distribution is usually unknown, it is important to study the robustness of the proposed procedures. We perform an extensive simulation study to compare the percentage of confidence intervals containing the true population mean using the two proposed algorithms with the percentage obtained from the traditional method based on the central limit theorem. It is shown that the normal algorithm is the most robust procedure against many different distributional error assumptions.     

论量刑程序改革

量刑程序改革是对我国现行法律规定和相关理论的贯彻落实,其目标是为了纠正片面的司法观念,解决量刑的失衡问题,实现量刑的公平正义,加强对公民权利的保障。量刑程序改革的价值应包括公正、公开和效率。在优化资源配置的基础上,我国可以采用混合型的定罪量刑关系模式。     

A hybrid genetic algorithm/mathematical programming approach to the multi-family flowshop scheduling problem with lot streaming

This paper presents a hybrid genetic algorithm/mathematical programming heuristic for the n-job, m-machine flowshop problems with lot streaming. The number of sublots for each job and the size of sublots are directly addressed by the heuristic and setups may be sequence-dependent. A new aspect of the problem, the interleaving of sublots from different jobs in the processing sequence, is developed and addressed. Computational results from 12 randomly generated test sets of 24 problems each are presented.     

民事诉讼的和谐机理与制度重构

诸多民事诉讼制度都有助于社会的和谐与稳定.然而我国现有一些民事诉讼制度并未切实有效地发挥这一机能.在和谐社会建构这一时代主题下,应进一步改革和完善我国现有民事诉讼制度,进而充分实现和发挥其有助于社会和谐稳定的内在机能.     

论民事执行中的举报人

民事执行中的举报人在立法和学理上研究较少,因其与被执行人财产的查明关系密切而具有重要的作用。构建举报人制度不但要明确其立法地位,举报的对象和适用范围,举报人加入到强制执行中的方式,还要明确悬赏公告的发布程序和内容,需谨慎设计举报人的权利和义务等各方面程序上的内容。     

法律进化论视角下的刑事诉讼模式理论研究

以法律进化论为视角,以美国学者帕卡的刑事诉讼模式理论为研究背景,运用价值分析法,在立足传统研究成果的基础上,剖析了我国刑事诉讼模式重构可能存在的误区,并建议以本土法制资源和环境的改善为出发点,在强调制度整体性的基础上重构我国的刑事诉讼模式。     

区分工作流程与典型工作任务的课程改革基本方法

在高等职业教育工学结合的课程改革过程中,财经类课程改革遇到了很大的困难,其基本方法始终处于探索之中而不够明确。笔者结合北京财贸职业学院工商管理系全国示范校建设重点专业——连锁经营管理专业在课程改革中的经验,借鉴管理大师德鲁克的团队理论,总结出区分工作流程与典型工作任务的课程改革基本方法。     

内容出自形式吗——略评哈贝马斯的“对话伦理学”

近代西方"内容出自形式"神话的构建历史,可从康德"绝对命令"开始,直到罗尔斯的"社会契约"论和哈贝马斯的"对话伦理学"。哈氏"对话伦理学"的纯粹形式倾向,体现在"交往的不可避免性,论证性原则,最后根据的问题"等三项基本要义之中。"形式不可能产生内容",因而对哈氏神话必须进行反思和批判,基于经验、内容及人的法权,尝试构建实体论证的程序正义论。
