理性视角下的刑法严格责任探析

严格责任是对传统"无过错则无犯罪原则"一定程度一定范围内的突破。严格责任由绝对向相对的演进反映出其制度设计上应尊重的两条基本原则,即赋予相对方充分防御权及公权力干预社会生活的有限性。鉴于我国社会生活的复杂化,公民难以仅凭自己的理性对此作出合理的判断并以此保护自身的合法利益,因此,在刑事立法上相对严格责任具有一定的可采性。     

双重赋形的新诗阐释学实践--评肖学周博士新著《为新诗赋形》

重新审视新诗的精神遗产是诗歌研究界不可回避的问题,肖学周新著《为新诗赋形》直面新诗语言问题,以闻一多为个案,全面系统地梳理了闻一多诗歌语言的多方面的特征,厘定闻一多新诗创作的历史地位与现实意义。在方法论上体现为对新诗赋形的理论赋形,即双重赋形,这一新诗阐释学实践无疑具有积极的启示。

Goodness-of-fit tests for Pareto distribution based on a characterization and their asymptotics

In this paper we present a new characterization of the Pareto distribution and consider goodness-of-fit tests based on it. We provide an integral and Kolmogorov–Smirnov-type statistics based on U-statistics and we calculate Bahadur efficiency for various alternatives. We find locally optimal alternatives for those tests. For small sample sizes, we compare the power of those tests with some common goodness-of-fit tests.     

Empirical Bayes estimation of parameters in Markov transition probability matrix with computational methods

Empirical Bayes estimator for the transition probability matrix is worked out in the cases where we have belief regarding the parameters, For example, where the states seem to be equal or not. In both cases, priors are in accordance with our beliefs. Using EM algorithm, computational methods for different hyperparameters of the empirical Bayes are described. Also, robustness of empirical Bayes procedure is investigated.

我国司法实践中对于刑民交叉案件,在处理机制上主要依据先刑后民原则,该原则是否应被看作一种法律原则来适用,其是否有法律依据,如何界定该原则的适用范围,以及对其存在的意义如何评价,是主要阐述的问题.     

全球化的文化思考

本文主要论述了全球化的内涵、效应、价值意蕴以及由此而引发的深层文化冲撞问题。认为全球化的内涵首先是自然理性形态的全球化,如哲学、技术等领域,而不仅仅是经济的全球化。全球化的双重效应促使人类形成共同利益以及共同价值,但仍然难以避免不同文化间的碰撞。     

高校创业孵化器与创业精神教育研究

本文对创业教育发展及高校创业孵化器的可行模式作了研究,认为高校创业孵化器应该实现也必须实现既孵化企业又孵化人才的“双孵化”功能,并构建了一个结合孵化器的创业精神教育体系,提出了强化学生创业精神的目标、内容和措施。     

Electile Dysfunction

This essay combines Burke's burlesque frame and Jamieson's double binds to create a hybrid gendered theory for rhetorically analyzing the aggressive sexualization of 2008 United States vice presidential candidate Sarah Palin. The essay develops our theory titled the “burlesque binds” and explicates a specific form of a burlesque bind: the “MILF frame.” Palin's aggressively sexualized representation was united under the crass acronym MILF, which stands for “Mom I'd Like to Fuck.” The MILF frame emphasized Palin's feminine qualities, positioning her as a “trophy vice” with no political acumen, and highlighted her masculine behaviors, but deflated them through sexual objectification. The unification of the binds and burlesque theories reveals how Palin's role as a social actor was not simply circumscribed but shut down: she was deemed unfit by both masculine and feminine standards, by both public and private sphere conventions. Although Sarah Palin has arguably been the most prevalent subject of the political MILF frame, our essay catalogues other instances of female political leaders experiencing this type of symbolic degradation, suggesting the MILF frame's vast influence.     

Noninformative priors for linear combinations of normal means with unequal variances

For normal populations with unequal variances, we develop matching priors and reference priors for a linear combination of the means. Here, we find three second-order matching priors: a highest posterior density (HPD) matching prior, a cumulative distribution function (CDF) matching prior, and a likelihood ratio (LR) matching prior. Furthermore, we show that the reference priors are all first-order matching priors, but that they do not satisfy the second-order matching criterion that establishes the symmetry and the unimodality of the posterior under the developed priors. The results of a simulation indicate that the second-order matching prior outperforms the reference priors in terms of matching the target coverage probabilities, in a frequentist sense. Finally, we compare the Bayesian credible intervals based on the developed priors with the confidence intervals derived from real data.
