金融改革浪潮下的韩国资本市场法——以投资者保护制度为中心的考查

全球金融改革的浪潮下,2009年制定的韩国资本市场法顺应时代的潮流采取功能型立法模式允许兼业经营的同时,兼顾了投资者利益的保护。首先,将投资者区分为一般投资者与专业投资者,针对不同类型的投资者采取不同的保护方法。其次,构建利益冲突防御体系、规制投资劝诱行为以及规制投资广告,强化金融投资公司在买卖金融投资商品中的说明义务、适合性原则等具体措施强化对一般投资者的保护。     

民国时期的“回族界说”与中国共产党《回回民族问题》的理论意义

现有研究表明,中国讲汉语的回回在晚明已经形成为一个具有共同祖先认同的独特的族类群体(民族),但是到晚清特别是辛亥革命之后,出现回回学者关于"回族界说"的争议,而且大多数回回精英都不主张回族是一个独立的"民族",也不赞成使用"回族"的称呼。本文认为回回精英的这种立场,主要是因为从西方传入的"民族"概念蕴含"一个民族一个国家"的意义,而中国的回回用"争教不争国"表达了在政治上认同中国的生存策略。这种生存策略的确定,不仅与清代后期的民族压迫有关,而且也受到民国期间中国大社会(国民党和大多数主流学者)的"民族"理论和方针的影响。反观中国共产党的《回回民族问题》(1941年),一方面尊重学理,没有否认中国多民族国家中存在汉族以外的"民族";另一方面修正了少数民族"民族自决"的主张,改为民族平等下的"民族自治"。其在学理上确立了多民族国家中真正实行民族平等政策的理论基础,同时也为中国回回民族指明了不需要否认自己民族身份的发展道路。     

Estimation and comparison of lognormal parameters in the presence of censored data

It is assumed that k(k?>?2) independent samples of sizes n _i (i?=?1, …, k) are available from k lognormal distributions. Four hypothesis cases (H ₁ – H ₄) are defined. Under H ₁, all k median parameters as well as all k skewness parameters are equal; under H ₂, all k skewness parameters are equal but not all k median parameters are equal; under H ₃, all k median parameters are equal but not all k skewness parameters are equal; under H ₄, neither the k median parameters nor the k skewness parameters are equal. The Expectation Maximization (EM) algorithm is used to obtain the maximum likelihood (ML) estimates of the lognormal parameters in each of these four hypothesis cases. A (2k???1) degree polynomial is solved at each step of the EM algorithm for the H ₃ case. A two-stage procedure for testing the equality of the medians either under skewness homogeneity or under skewness heterogeneity is also proposed and discussed. A simulation study was performed for the case k?=?3.     

On a minimum distance estimate of the period in functional autoregressive processes

We consider a continuous time random process with functional autoregressive representation. We state statistical results on a mean functional estimator determining a minimum distance estimator of the period giving consistency and a limit law stated in Mourid and Benyelles [13 Mourid, T. and Benyelles, W. 2002. Estimation de la p ériode de la représentation autorégressive d'un processus à temps continu. : 89–101. Annales de l'I.S.U.P, Volume XXXXVI-Fascicule 1–2 [Google Scholar]]. Then we discuss their performance on numerical simulations and on real data analyzing the cycle of a climatic phenomena.     

OECD's ‘Better Life Index’: can any country be well ranked?

We critically review the Better Life Index (BLI) recently introduced by the Organization for Economic Co-operation and Development (OECD). We discuss methodological issues in the definition of the criteria used to rank the countries, as well as in their aggregation method. Moreover, we explore the unique option offered by the BLI to apply one's own weight set to 11 criteria. Although 16 countries can be ranked first by choosing ad hoc weightings, only Canada, Australia and Sweden do so over a substantial fraction of the parameter space defined by all possible weight sets. Furthermore, most pairwise comparisons between countries are insensitive to the choice of the weights. Therefore, the BLI establishes a hierarchy among the evaluated countries, independent of the chosen set of weights.     

A Note on Generalized Functional Linear Model and Its Application

Motivated by a biomarker study for colorectal neoplasia, we consider generalized functional linear models where the functional predictors are measured with errors at discrete design points. Assuming that the true functional predictor and the slope function are smooth, we investigate a two-step estimating procedure where both the true functional predictor and the slope function are estimated through spline smoothing. The operating characteristics of the proposed method are derived; the usefulness of the proposed method is illustrated by a simulation study as well as data analysis for the motivating colorectal neoplasia study.

Redefining antiracism: Learning from activists to sharpen academic language

People have fought against racism for as long as it has existed and yet it persists in diverse and materially impactful ways. The primary challenge to eradicating racism is likely the power of white privilege. This paper argues that another important obstacle to progress has been the lack of a clear definition of antiracism that movement activists and scholars can collaboratively use to ensure that antiracist scholarship and efforts meet the full measure of the term's intention. While academia has struggled to converge on a definition, “lay race theorists” and movement activists—Black women in particular, have been participating in discourse online and through other venues where consensus appears to be developing around a definition. This article attempts to summarize activist discourse in defining antiracism as “the commitment to eradicate racism in all its forms” and individual antiracism as “the commitment to eradicate racism in all its forms, by (1) building an understanding of racism and (2) taking action to eliminate racism “within oneself, in other people, in institutions, and through actions outside of institutions,” noting that “antiracism is an ongoing practice and commitment that must be accountable to antiracist Black people, Indigenous people, and other People of Color and consider intersectional systems of oppression.” While research on the public conversation benefits from its easy access and limited additional burdens on movement activists, future research should test these definitions with movement activists to ensure that definitions and metrics are as relevant to the antiracist movement as possible.
