对加强检察机关案件质量管理的思考

案件质量管理是检察机关工作的重中之重,近年来,全国各级检察机关认真贯彻高检院规定,切实加强案件质量管理,取得明显成效,但也存在一些不容忽视的问题。从人员、机构、意识、素质、机制等多方面进行思考,提出了一些解决问题的措施,以达到加强检察机关案件质量管理的目的。     

智慧检务下的捕诉一体建设

作为新时代检察工作发展需要的产物,智慧检务具有增强司法规范、提升司法效率等功能价值。在我国司法实践中,“捕诉一体”办案机制主要存在着三方面的困境。一是批捕质量和监督力度阶段性下降;二是案件办理尺度不统一、标准不一致;三是考评制度未能及时更新、跟进。将智慧检务与“捕诉一体”办案机制深入融合,以检察科技创新为突破口,能有效提高检察官综合素质、创新监督方式、规范检察行为等,为完善“捕诉一体”办案机制提供有力的科学支撑。     

Construction of Health Indices Using Paired Comparisons

The paper discusses, by making use of past experiences in the area, the main issues and the methodology of developing a health status instrument for a developing country from a well-established instrument. The use of Thurstone's model of paired comparisons in evaluating the relative importance of health symptoms has been reviewed and some alternative models, i.e., Linear, Exponential, and Information, are proposed. By applying the models to the health data of Chinese elderly persons, the three models have been demonstrated to be able to produce some valid and responsive health scores.     

Logrank test for bivariate survival data

The logrank test procedure for testing bivariate symmetry against asymmetry in matched-pair data is proposed. The presented test statistic is based on Mantel-Haenszel type statistics evaluated at diagonal grid points on the plane obtained from distinct uncensored failure times. The asymptotic results of the proposed test are derived and an example is shown to illustrate the methodology.     

Optimal design results for 2n factorial paired comparison experiments

Four general classes of partially balanced designs for 2ⁿ factorials, corresponding to four different forms of a general null hypothesis H on factorial effects, are presented. For the typical design in each class, the simplified form of the non-centrality parameter λ² of the asymptotic chi-square distribution of the likelihood ratio statistic for testing the corresponding form of H₀ is derived under defined local alternatives. Optimal designs d₁ maximizing λ² in the i-th class and minimizing the trace, determinant and largest eigenvalue of a defined covariance matrix, i =1,…,4, are determined.     

A sample size selection procedure for pairwise comparisons of means with unequal variances

A sample size selection procedure for paired comparisons of means is presented which controls the half width of the confidence intervals while allowing for unequal variances of treatment means.     

我国设立沉默权制度的思考

沉默权是一个古老的话题,在今天高度民主?文明的社会里它显得更加的重要。它在许多国家都得到了确立,那么正在走向法治化的我国沉默权又作了哪些规定呢?“沉默权”的起源是怎样的?我国“沉默权”的现状如何?我国是否也确立了“沉默权”制度?究竟我国是否要设立“沉默权”制度等问题都是值得我们去研究和探索的。     

人民监督员制度实效性探究

人民监督员制度是检察机关的接受外部监督的重要举措。为进一步完善人民监督员制度．应对该制度实效性的制约因素进行系统分析。强化人民监督员制度的实效性可考虑从完善任职条件、规范监督程序、加强监督意见的效力以及借鉴域外司法制度等方面入手。     

国际司法机构判决的执行监督机制

随着全球化和一体化的深入发展,司法化已经成为当代国际法的重要特征之一。国际司法机构在和平解决国际争端乃至国际法中的地位和作用日益受到重视,而其作用的切实发挥取决于判决的遵守与执行。通常自愿执行国际法院的判决是承认国际法院管辖权的必然结果,但设立判决执行监督机制也是必要的。通过着重介绍国际司法机构判决执行监督机制的性质,比较主要国际司法机构判决执行监督的程序及有关实践,分析判决执行监督机制对国际法,乃至整个国际社会的作用,揭示可能存在的问题,并得出如下结论:首先,国际司法机构的判决执行监督机制与国际法的监督执行类似,但与国内法的执行存在根本区别;其次,判决执行监督机制的效用受多重因素的影响;最后,有效的判决执行监督机制可能加剧国际司法机构的分散化激增造成的国际法碎片化问题,如何正确的看待和解决这个问题。     

论权力机关监督监察机关的路径完善——兼论监督法的修改

当前权力机关对监察机关的监督存在国家法律规范的供给不足和迟缓、监督工具不够丰富具体、监督程序公开不到位且衔接不足等问题。同时,监察机关“位高权重”,使得权力机关监督略显乏力。因此,应进一步健全《监督法》,扩大监督主体范围,创新监督举措,完善特定问题调查制度,增设法律责任章节,完善监督程序的具体法律规定;丰富和具象监督“工具箱”,加强对监察相关法律的执法检查,对监察机关发布的法规和相关规范性文件进行备案审查,强化监察机关的询问与质询;推动监督程序公开,加强各种监督方式间的衔接,完善跟踪反馈环节,切实增强权力机关监督监察机关的有效性。
