现行三大诉讼法均未明确规定将测谎结论作为证据种类单列,诉讼法学界对此也存有争议。首先通过对否定测谎结论作为证据的观点进行反证分析后认为:测谎结论具有证据的客观真实性和关联性,可作为诉讼证据使用;再将测谎结论与司法精神病鉴定进行对比分析后认为,测谎结论可归于证据种类中鉴定意见一类。最后,建议对测谎技术作如下规范:一是制定行业标准,严格规范测谎员的资格认证;二是加强对测谎鉴定机构的监管。 相似文献

In sequential plays with two players, the players have the opportunity to use information on opponents’ past moves in selecting a move for the current stage. Strategies for Player II are considered in our study, in particular, play against the random past (PRP) strategy. In this paper, PRP strategy will be reviewed and discussed. Hannan consistency of PRP strategy in term of regret (difference in average loss and an envelope loss) on k-extended Bayes envelope risk problem in matching binary bits game will be shown. The simulation of two-experts selection problem on real experts’ forecasting data of IBM share earnings confirms the consistency of PRP strategy. 相似文献

The bounding analysis methodology described by Ha-Duong et al. (this issue) is logically incomplete and invites serious misuse and misinterpretation, as their own example and interpretation illustrate. A key issue is the extent to which these problems are inherent in their methodology, and resolvable by a logically complete assessment (such as Monte Carlo or Bayesian risk assessment), as opposed to being general problems in any risk-assessment methodology. I here attempt to apportion the problems between those inherent in the proposed bounding analysis and those that are more general, such as reliance on questionable expert elicitations. I conclude that the specific methodology of Ha-Duong et al. suffers from logical gaps in the definition and construction of inputs, and hence should not be used in the form proposed. Furthermore, the labor required to do a sound bounding analysis is great enough so that one may as well skip that analysis and carry out a more logically complete probabilistic analysis, one that will better inform the consumer of the appropriate level uncertainty. If analysts insist on carrying out a bounding analysis in place of more thorough assessments, extensive analyses of sensitivity to inputs and assumptions will be essential to display uncertainties, arguably more essential than it would be in full probabilistic analyses. 相似文献

This article describes a Delphi‐based expert judgment study aimed at the selection of indicators to identify the occurrence of emerging mycotoxin hazards related to Fusarium spp. in wheat supply chains. A panel of 29 experts from 12 European countries followed a holistic approach to evaluate the most important indicators for different chain stages (growth, transport and storage, and processing) and their relative importance. After three e‐mailing rounds, the experts reached consensus on the most important indicators for each of the three stages: wheat growth, transport and storage, and processing. For wheat growth, these indicators include: relative humidity/rainfall, crop rotation, temperature, tillage practice, water activity of the kernels, and crop variety/cultivar. For the transport and storage stage, they include water activity in the kernels, relative humidity, ventilation, temperature, storage capacity, and logistics. For wheat processing, indicators include quality data, fraction of the cereal used, water activity in the kernels, quality management and traceability systems, and carryover of contamination. The indicators selected in this study can be used in an identification system for the occurrence of emerging mycotoxin hazards in wheat supply chains. Such a system can be used by risk managers within governmental (related) organizations and/or the food and feed industry in order to react proactively to the occurrence of these emerging mycotoxins. 相似文献

Stakeholders making decisions in public health and world trade need improved estimations of the burden‐of‐illness of foodborne infectious diseases. In this article, we propose a Bayesian meta‐analysis or more precisely a Bayesian evidence synthesis to assess the burden‐of‐illness of campylobacteriosis in France. Using this case study, we investigate campylobacteriosis prevalence, as well as the probabilities of different events that guide the disease pathway, by (i) employing a Bayesian approach on French and foreign human studies (from active surveillance systems, laboratory surveys, physician surveys, epidemiological surveys, and so on) through the chain of events that occur during an episode of illness and (ii) including expert knowledge about this chain of events. We split the target population using an exhaustive and exclusive partition based on health status and the level of disease investigation. We assume an approximate multinomial model over this population partition. Thereby, each observed data set related to the partition brings information on the parameters of the multinomial model, improving burden‐of‐illness parameter estimates that can be deduced from the parameters of the basic multinomial model. This multinomial model serves as a core model to perform a Bayesian evidence synthesis. Expert knowledge is introduced by way of pseudo‐data. The result is a global estimation of the burden‐of‐illness parameters with their accompanying uncertainty. 相似文献
