国际公法对弱者的保护及其完善

鉴于弱者保护已成为国际社会普遍关注的热点问题,但时下无论是国内立法还是社会各界对弱者的特殊保护都不同程度地存在一些认识问题或实际问题,依照国际社会公认的保护弱者的国际公约,在对其一系列原则、制度和规则予以详细阐述的基础上,提出进一步完善该方面国际国内立法的思考和建议。     

论损害赔偿限额的非正当性——以国际航空运输承运人责任为例的研究

《华沙公约》及其华沙体制的一个显著特点,是建立了统一的损害赔偿限额。围绕损害赔偿限额的正当性与非正当性之争,在华沙体制建立伊始就已经开始了,并且一直是国际航空法上广受争议的问题。损害赔偿限额在侵权法中,并非严格责任或者推定过错责任的本质特征。损害赔偿限额在理论上缺乏正当性。国际航空运输承运人责任中损害赔偿限额的产生与发展对我国民用航空法具有重大的启示。

北宋书序作者所选择的传播因素分析

书序具有重要的传播作用,以北宋诗文集序为对象考察,书序作者在选择推动传播的因素时,对作品艺术性、知识性等文本因素的关注不如对作家身份、生平轶事等非文本因素普遍。其中原因,从书序作者的操作层面来看,是因为在书序中进行文艺批评是很难把握的;从面对读者的传播效果层面来分析,是因为非文本因素较之文本相关的评论因素可以产生显著的传播效果。于是,非文本因素在文学传播中变成了一位无形的操纵者,虽然它不是长远的传播之道,但却常常起着奇妙的传播作用,从而给书序这一文体增加活力。     

Methodological Approaches to Assessing Risk Perceptions Associated with Food-Related Hazards

The psychometric approach developed by Slovic and his co-workers has been effectively used to assess risk perceptions associated with different food-related hazards. However, further examination (using questionnaire data and partial correlation techniques) has indicated that technological hazards are highly differentiated from lifestyle hazards, in terms of both hazard control and knowledge about the hazard. Optimistic bias was also seen to vary between hazards. Further research has focused on a particular hazard, genetic engineering. Risk perceptions associated with genetic engineering are underpinned by ethical concern and questions relating to perceived need for the technology, as well as perceptions of risk or harm. However, increasing the specificity of hazard stimuli was found to alter the factor structure of underlying risk perceptions. The utility of preference mapping procedures in determining individual differences in trust in risk regulators is also discussed.

The cluster that never was: germ warfare experiments and health authority reality in Dorset

In 1997 intense media coverage raised public concerns about germ warfare simulation experiments conducted by the Ministry of Defence during the 1960s, which included the release of bacteria over Dorset. Families in East Lulworth, Dorset, have linked this with allegedly high rates of miscarriages, still-births, congenital malformations, learning and other neurodevelopmental disabilities in their village. The response of the Dorset Health Authority (DHA) included the examination of background information from the Ministry of Defence, national data on congenital malformations in Dorset, health information collected by campaigners and a systematic health survey conducted by the DHA among former and current residents of East Lulworth. The investigation did not confirm the presence of a cluster. It is debatable whether the DHA should have proceeded with their survey when none of the other more immediately available results indicated the presence of a cluster.     

A stepwise discrete variable selection procedure

A stepwise variable selection procedure for multinomial discrimination is presented and discussed. Based upon the work of Kullback and Hills, stopping rules are proposed and illustrated for a set of data on communication buyer behavior.
