随着我国进入社会转型时期,社会经济快速发展,人民生活水平得以大幅度提升的同时,因转型期社会所特有的无序化、碎片化、个体化以及价值紊乱等现象而引发的社会冲突日益凸显,其中"官民"冲突尤为突出。对此,行政诉讼作为解决"官民"冲突纠纷,维护社会公平正义的重要防线在我国目前特殊法治建设环境中尤为必要。而在行政诉讼过程中基于对法律效果与社会效果的具体考量以决定最为妥当的法律适用,是充分发挥行政诉讼有效处理行政争议、维护社会和谐稳定作用的重要路径之一。但当前我国行政诉讼中法律适用在合理性标准、法官个人职业素质以及监督评价体系等方面存在诸多问题,影响行政诉讼在解决争议以及维护社会和谐稳定作用方面的充分发挥。据此,文章结合行政诉讼中法律适用问题研究的必要性,通过对行政诉讼中法律适用基本内涵及正当性基础的解读,分析行政诉讼中法律适用面临的主要问题,进而提出完善对策,以期通过明确其合理性标准、提高法官职业素质、完善监督评价体系等措施,保障行政诉讼中法律适用的规范化开展。  相似文献

This study was motivated by the key role university degree holders play in Malaysia's vision for the future and by concerns expressed about the drift of university degree holders from one sector to another. A questionnaire was mailed to a sample of 400 Malaysian families that had at least one member who held a university degree. The objective was to elicit details of the household economic situation of respondents, with special reference to the differences in expenditure patterns between families whose degree holder worked in higher education, government, or the private sector.Results of tobit analysis of expenditures show that there are some differences between the sectors regarding expenditure patterns, but the differences are not as great as expected. Nevertheless, university-educated persons in the private sector seem to have somewhat different expenditure patterns than their counterparts in other sectors.  相似文献

  员工离职一直以来是理论界和实务界关注的热点,对员工离职的研究主要聚焦于员工离职倾向和离职行为,并主要从个体和情景因素探讨员工离职倾向或离职行为的影响因素,但具有离职倾向却未发生实际离职行为的员工在组织中表现如何,还有待进一步研究。         根据计划行为理论,个体会基于自己的内在倾向采取相应的行为,但是内在倾向与行为之间的关系受到一定的约束,尤其受到个体是否能够决定或控制这种行为的影响。自我效能感反映了个体认为自己能够处理问题的信心,主动性人格则反映了个体是否具有按照自己的意愿采取行为的自主权,二者均反映了个体对行为的控制度。构建以离职倾向为前因变量,以自我效能感和主动性人格为调节变量,以任务绩效、帮助行为和反生产行为为结果变量的理论模型。基于886名员工和231名配对领导的两阶段数据,使用Mplus 7.0进行数据分析和假设检验。为避免领导评价的嵌套效应,采用三明治分析方法进行分析。         研究结果表明,①自我效能感正向调节离职倾向与反生产行为的正向关系,即高自我效能感的员工在相同水平离职倾向下会做出更多反生产行为;②主动性人格正向调节离职倾向与任务绩效的负向关系,即高主动性人格的员工在相同水平离职倾向下表现出更差的任务绩效;③主动性人格正向调节离职倾向与帮助行为的负向关系,即高主动性人格的员工在相同水平离职倾向下会做出更少帮助行为;④主动性人格正向调节离职倾向与反生产行为的正向关系,即高主动性人格的个体在相同水平离职倾向下会做出更多反生产行为。         研究发现离职意愿提高员工反生产行为,在产生离职倾向后高自我效能感和高主动人格的员工更会有消极表现。研究结果启示管理者需多观察员工行为,把握员工离职倾向,重视主动性人格可能存在的消极作用,引导主动性人格的员工发挥积极作用。  相似文献

Technology infusion into service procedures has enhanced the rise of self-service technology. Technology-based services help businesses provide more flexibility, efficiency, and variety to customers. Therefore, it increases the customer??s perceived value from the business??s viewpoint. However, technology-based services are usually novel to most customers. As a result, customers who lack sufficient experience with using technology-based services may feel extreme frustration. The purpose of this study was to empirically examine how technology readiness (TR) affects customer perceived value (CPV). Data were collected from consumers who took the high speed rail in Taiwan in June 2009. As expected, optimism and innovativeness had positive impacts on CPV while discomfort and insecurity had negative impacts on CPV. The four TR dimensions all had significant, but not equal, impacts on CPV. Optimism had the highest impact on CPV. TR had no significant impact on emotional value. Social value and security value were significantly and positively affected by TR.  相似文献

在当前司法体制改革中,对检察权的性质,学界与司法实务部门存在着较大争论。本文认为,对我国检察权性质的讨论应以建国初期作为逻辑起点。当时,中国的检察权是有自身特色的司法权,它的司法权属性渊源于苏联的司法理论及其实践;而它的中国特色则带有深深的时代烙印。只有理解了检察权这一逻辑起点的时代合理性与时代局限性,才能更理性地认识当下有关检察权性质争论的必要性与重要性。  相似文献

The coal mine production industry is a complex sociotechnical system with interactive relationships among several risk factors. Currently, causation analysis of gas explosion accidents is mainly focused on the aspects of human error and equipment fault, while neglecting the interactive relationships among risk factors. A new method is proposed through risk coupling. First, the meaning of risk coupling of a gas explosion is defined, and types of risk coupling are classified. Next, the coupled relationship and coupled effects among risk factors are explored through combining the interpretative structural modeling (ISM) and the NK model. Twenty‐eight representative risk factors and 16 coupled types of risk factors are obtained through analysis of 332 gas explosion accidents in coal mines in China. Through the application of the combined ISM–NK model, an eight‐level hierarchical model of risk coupling of a gas explosion accident is established, and the coupled degrees of different types of risk coupling are assessed. The hierarchical model reveals that two of the 28 risk factors, such as state policies, laws, and regulations, are the root risk factors for gas explosions; nine of the 28 risk factors, such as flame from blasting, electric spark, and local gas accumulation, are direct causes of gas explosions; whereas 17 of the risk factors, such as three‐violation actions, ventilation system, and safety management, are indirect ones. A quantitative analysis of the NK model shows that the probability of gas explosion increases with the increasing number of risk factors. Compared with subjective risk factors, objective risk factors have a higher probability of causing gas explosion because of risk coupling.  相似文献

为了更好的评价我国商业银行的效率,在传统两阶段DEA模型中引入交叉效率,并对两阶段生产系统的内部结构进行优化,构建了考虑共享投入和非期望产出的两阶段交叉效率模型。最后结合中国16家商业银行2006-2015年的年度报表,分别应用传统的两阶段DEA模型和新模型评价样本银行的效率。结果表明:新模型比传统模型更客观、区分力更强,具有更强的稳定性,更适合用于评价我国商业银行的效率。  相似文献
