论"通知—删除"规则的性质——以平台自治为视角

"通知—删除"规则的法律条文并没有赋予平台自治的空间,但是平台自治的需求已经"凸显".免责条款理论表面上能保障平台自治,但是并不符合我国的实际.归责条款理论是我国的通说,其扼杀了平台自治的空间,司法实践对此虽有调和,但是难以济事.我国的"通知—删除"规则系特定的历史背景下的产物,其在性质上仅仅是行为标准.在侵权行为的认定上,违反"通知—删除"规则的情形并非侵权的充分条件.事实上,这一行为标准的违反在侵权法上的意义仅仅作为主观过错的证据,电商平台可以反证其不具有过错.司法实践中亦有区别对待"通知—删除"规则的违反和侵权之认定的做法.明晰此点方可保障平台自治,同时亦实现电商平台对用户监管之目的.     

论普里什文哲理散文中的生态文学思想与猎人情结

普里什文哲理散文中所具有的预言式生态思想与环保理念备受当代“生态文学”理论家的青睐。但他热衷描写狩猎场景的猎人情结却又遭到新世纪中“生态伦理”理论的诟病。其实从文本的本体性观念来理解，普里什文的诗性自然情怀、生态观念与他的猎人情结并非只有冲突的一面，他所表达出的是人对大自然万物之本能与道义之间的尺度衡量，而这种衡量也可反观当代人与自然万物之间的关系的现状，实际上表达出一种更为深刻的天人关系的批判性。

The disembedded digital economy: Social protection for new economy employment in China

This research focuses upon employment in the new economy, exploring labour protection and social protection in the digital age in China. Through an empirical survey conducted in three Chinese cities, social insurance and the labour rights of employees in the digital economic sector, such as gig employment, e-commerce, and various other forms of online employment, have been examined in-depth. This study reveals new regulatory loopholes in the digital labour market, which have substantially eroded the basis of social policy arrangements in China, “softening” participation in social insurance branches and compliance with labour regulations remarkably. Drawing upon the theoretical concepts of Polanyi on embeddedness and disembeddedness, we argue that the digital employment sector in China has been increasingly disembedded from social institutions and social control. The new configuration in the digital field of social policy requires novel conceptual models and institutional settings to cope with increasing social risks in virtual spaces.     

市场分割、政企关系与异地市场拓展

中国的市场仍旧存在某种程度的分割，如何突破这种市场分割到异地拓展市场是企业要考虑的现实问题。以前的研究主要是从省级层面或国家层面进行宏观分析。文章创新地从政企关系视角入手来考察市场分割情形下微观层面的企业异地市场拓展，也是首先把市场分割（和异地市场）分为省内（本市外）市场、省外市场和海外市场三个不同层面来研究的论文。用世界银行的调查数据从微观企业个体层面检验了企业异地市场拓展的可能。实证研究结果发现，市场分割确实阻碍了企业异地市场拓展，但这仅限于省内市场而不是省外市场。此外，市场分割是有方向性的，从地方保护主义严重的市场里走出来的企业更容易拓展异地市场，但此结论仅适用于国内市场拓展而不适用于海外市场拓展。良好的政企关系是有利于企业异地市场拓展的，但仅限于省外市场，对省内市场以及海外市场是无效的。文章解释了其中的原因，并分析了对于企业实践的启示。     

Multi-valued strategy-proof social choice rules

In this paper we introduce a new definition of strategy-proofness for multi-valued social choice correspondences. We prove two Gibbard-Satterthwaite type results for strategy-proof social choice correspondences. These results show that allowing multiple outcomes as social choices will not necessarily lead to an escape from the Gibbard-Satterthwaite impossibility theorem. A Sociology of the Periphery Versus a Peripheral Sociology: Rural Sociology and the Dimension of Space1

Abstract Rural sociology is intrinsically concerned with the spatial dimensions of social life. However, this underlying research tradition, particularly the use of space as a research strategy, has been insufficiently addressed and its contributions to general sociology are little recognized. I outline how concern with space, uneven development, and the social relationships of peripheral settings have provided substantive boundary and conceptual meaning to rural sociology, propelled its evolution, and left it with a legacy of strengths, weaknesses, and challenges. A willingness to tackle the dimension of space and the thorny problems it raises often sets rural sociologists apart from other sociologists. This research tradition contrasted with general sociology's concern with developing generalization, aspatial covering laws, and proto-typical relationships of modern or Fordist development settings. Conceptual openings have left sociologists questioning their past agenda. Coupled with the “creative marginality” inherent in the questions and contexts addressed by rural sociologists, this makes the subfield central to contemporary sociology.
