民族学的民族国家形态及其他——中国民族学史散论

本文围绕民族学/人类学的民族国家形态、民族学和中国的现代性、殖民主义和中国民族学等三个论题,结合中国民族学的发展史,对中国民族学知识的发展及其性质展开深入的理论探讨和反思。其中,对民族学知识中国形态的发展及其学术价值所作的细致分析,以及对现代性和殖民主义在中国民族学发展上的影响所给予的分析和评价,对理解中国民族学史的发展,提供了较为新颖的视角。     

《回回原来》及其相关研究述评

本文对已往学术界对有关《回回原来》的研究作了较为细致的梳理,并将有关研究从方法上分为实证史学研究和民族民间文学研究两类。同时,对两种不同研究策略作了比较和评价。     

论回族“小经”文字及其保护措施

本文以民族文化中的瑰宝回族"小经"文字为研究对象,通过对"小经"的产生、发展、使用现状等一系列问题的阐述,逐步分析"小经"在现实中面临的问题,并归纳出现这种困境的原因,进而在剖析其存在的重要价值的基础上,提出解决"小经"文字保护的措施,为少数民族文化的保护提供有益的参考.同时,文中强调了少数民族传统文化的保护与传承的紧迫性.进一步阐释了保护少数民族非物质文化的重要性.     

Racial Disparities in Early Criminal Justice Involvement

Criminologists have long reported the existence of racial disparity in the criminal justice system, but the important question is why. While some argue that observed differences are a consequence of more criminal behavior among minorities, the weight of the evidence indicates that this is but a partial explanation. In this paper, we study data from a sample of juveniles to examine how racial differences in early police contact, and important social environments—family, school, and neighborhoods—affect later contact and arrests, controlling for self-reported delinquency. We find that early (in middle school) contact with police is an important predictor of later (high school) arrests. Also we found that, in addition to being male and living in a low-income family, children who have parents who have a history of arrest, who have experienced school disciplinary actions, who have delinquent peers, and who are in networks with deviant adults are more likely to have problems with law enforcement. These factors help to explain racial differences in police contacts and arrests.     

The Conversational Model and Child and Family Counselling: Treating Chronic Complex Trauma in a Systemic Framework

Child and Family Counselling Teams in NSW Community Health Services are expected to provide therapeutic services to children who have experienced complex trauma. However, parental trauma is often overlooked or referred elsewhere. A systemic perspective informed by attachment theory and trauma theory provides the basis for addressing parental trauma in Child and Family Counselling Teams, thereby improving parenting. The Conversational Model is an evidence‐based intervention for chronic complex trauma. The foundations of the Conversational Model and its brief component, Short Term Intensive Psychodynamic Psychotherapy, are outlined and a case study is given to illustrate the usefulness of the intervention in Child and Family Counselling. Highlighted is the importance of addressing systemic trauma through parenting to improve attachment quality, family relationships, and children's function.     

Presence Through Absence: Phylloxera and the Viticultural Imagination in McLaren Vale,South Australia

Grape phylloxera is an insect pest that has destroyed vineyards and brought ruin to winegrowing regions worldwide. In South Australia, however, strong biosecurity regulations have ensured it has remained absent. In this absence phylloxera takes on powerful symbolic value, and regional viticultural identities may be imagined in relation to the presence of phylloxera elsewhere. This paper draws from ethnographic research with grape growers and wine producers in McLaren Vale, a region whose vineyards are understood through this ‘phylloxera-free’ paradigm. The article specifically explores controversies around modification of South Australian biosecurity regulations in a way that favoured large winegrowing corporations’ need to more easily move material between regions, to the perceived detriment of vineyard security. The phylloxera risk has economic, social and symbolic dimensions in McLaren Vale, where the insect has become symbolically aligned with the most impersonal, pervasive and destructive aspects of globalised wine capitalism.     

民事发回重审之功能论

民事诉讼中发回重审在司法实践中确保初审程序的正当化,明确了上下级法院职能分工,保障诉讼当事人两审终审之利益。发回重审以其独有的功能而区别于其它二审裁决方式。但实务操作中因法律笼统规定等相关因素和制度本身种种弊端使得发回重审滥用现象严重,这也与民事诉讼追求的效率与公正价值取向背道而驰。虽然我国在2012年8月新修的《民事诉讼法》中完善了发回重审制度,但对于发回重审的具体事由以及相关处理程序仍有待规范。因此,适当限制发回重审是由,严格把控重审程序,给予当事人一定的程序选择权,对消解发回重审的滥用和当事人诉讼利益的保护,彰显法治权威和统一有着不可小觑的作用。     

Changing Spousal Roles and Their Effect on Recovery in Gamblers Anonymous: GamAnon,Social Support,Wives and Husbands

This paper examines changing spousal roles and their effects upon recovery in Gamblers Anonymous (GA). It is based upon a qualitative study designed to gage uniformity as well as variations in approaches to recovery in GA. Interviews were conducted with 39 GA members (26 men, 13 women; mean age 56.5 years). Though the study was based in the Toronto area, only 13 interviews involved participants from that region. Phone interviews were conducted with GA members from various regions of both Canada and the US. GamAnon, GA’s sister fellowship, has been designed for anyone affected seriously by someone’s gambling problem. In practice, GamAnon comprises mostly women––spouses of male GA members––who traditionally have taken a keen interest in the ways in which their husbands achieve and maintain abstinence from gambling. Changing spousal roles have led to fewer women joining GamAnon, as many opt instead to part with troubled spouses. As well, more women are attending GA than in the past, typically with husbands who are disinclined to join GamAnon. All of this has drastically altered how GA members pursue recovery. These changes and their implications are discussed.
