论"通知—删除"规则的性质——以平台自治为视角

"通知—删除"规则的法律条文并没有赋予平台自治的空间,但是平台自治的需求已经"凸显".免责条款理论表面上能保障平台自治,但是并不符合我国的实际.归责条款理论是我国的通说,其扼杀了平台自治的空间,司法实践对此虽有调和,但是难以济事.我国的"通知—删除"规则系特定的历史背景下的产物,其在性质上仅仅是行为标准.在侵权行为的认定上,违反"通知—删除"规则的情形并非侵权的充分条件.事实上,这一行为标准的违反在侵权法上的意义仅仅作为主观过错的证据,电商平台可以反证其不具有过错.司法实践中亦有区别对待"通知—删除"规则的违反和侵权之认定的做法.明晰此点方可保障平台自治,同时亦实现电商平台对用户监管之目的.     

论普里什文哲理散文中的生态文学思想与猎人情结

普里什文哲理散文中所具有的预言式生态思想与环保理念备受当代“生态文学”理论家的青睐。但他热衷描写狩猎场景的猎人情结却又遭到新世纪中“生态伦理”理论的诟病。其实从文本的本体性观念来理解，普里什文的诗性自然情怀、生态观念与他的猎人情结并非只有冲突的一面，他所表达出的是人对大自然万物之本能与道义之间的尺度衡量，而这种衡量也可反观当代人与自然万物之间的关系的现状，实际上表达出一种更为深刻的天人关系的批判性。     

四川盆地中三叠世盐盆分布与演化特征研究

四川盆地卤水分布广泛，资源丰富, 早为世人所瞩目，中三叠统雷口坡组是四川盆地最早开采天然气和盐卤的层系之一。根据盆地雷口坡组大量钻井资料研究表明，盆地雷口坡组主要成盐期分别为雷三2 期和雷四2 期，在盆地东部和南部由于受到古隆起的影响，盐岩地层已被剥蚀难以保存，现今盐岩主要分布在开江古隆起和泸州古隆起的西部以及天井山古隆起的南部（华蓥山以西—龙门山以东的川西—川中地区）。印支运动对盆地雷口坡组盐岩在平面的迁移起着十分重要的作用，根据不同时期盐岩统计数据看，两期盐盆在平面上具有向西迁移、叠加的特征，其中川中的GS1 井就钻遇了这两期的盐岩。     

Design selection for strong orthogonal arrays

Strong orthogonal arrays (SOAs) were recently introduced and studied as a class of space‐filling designs for computer experiments. An important problem that has not been addressed in the literature is that of design selection for such arrays. In this article, we conduct a systematic investigation into this problem, and we focus on the most useful SOA(n,m,4,2 + )s and SOA(n,m,4,2)s. This article first addresses the problem of design selection for SOAs of strength 2+ by examining their three‐dimensional projections. Both theoretical and computational results are presented. When SOAs of strength 2+ do not exist, we formulate a general framework for the selection of SOAs of strength 2 by looking at their two‐dimensional projections. The approach is fruitful, as it is applicable when SOAs of strength 2+ do not exist and it gives rise to them when they do. The disembedded digital economy: Social protection for new economy employment in China

This research focuses upon employment in the new economy, exploring labour protection and social protection in the digital age in China. Through an empirical survey conducted in three Chinese cities, social insurance and the labour rights of employees in the digital economic sector, such as gig employment, e-commerce, and various other forms of online employment, have been examined in-depth. This study reveals new regulatory loopholes in the digital labour market, which have substantially eroded the basis of social policy arrangements in China, “softening” participation in social insurance branches and compliance with labour regulations remarkably. Drawing upon the theoretical concepts of Polanyi on embeddedness and disembeddedness, we argue that the digital employment sector in China has been increasingly disembedded from social institutions and social control. The new configuration in the digital field of social policy requires novel conceptual models and institutional settings to cope with increasing social risks in virtual spaces.     

市场分割、政企关系与异地市场拓展

中国的市场仍旧存在某种程度的分割，如何突破这种市场分割到异地拓展市场是企业要考虑的现实问题。以前的研究主要是从省级层面或国家层面进行宏观分析。文章创新地从政企关系视角入手来考察市场分割情形下微观层面的企业异地市场拓展，也是首先把市场分割（和异地市场）分为省内（本市外）市场、省外市场和海外市场三个不同层面来研究的论文。用世界银行的调查数据从微观企业个体层面检验了企业异地市场拓展的可能。实证研究结果发现，市场分割确实阻碍了企业异地市场拓展，但这仅限于省内市场而不是省外市场。此外，市场分割是有方向性的，从地方保护主义严重的市场里走出来的企业更容易拓展异地市场，但此结论仅适用于国内市场拓展而不适用于海外市场拓展。良好的政企关系是有利于企业异地市场拓展的，但仅限于省外市场，对省内市场以及海外市场是无效的。文章解释了其中的原因，并分析了对于企业实践的启示。     

Multi-valued strategy-proof social choice rules

In this paper we introduce a new definition of strategy-proofness for multi-valued social choice correspondences. We prove two Gibbard-Satterthwaite type results for strategy-proof social choice correspondences. These results show that allowing multiple outcomes as social choices will not necessarily lead to an escape from the Gibbard-Satterthwaite impossibility theorem.
