论西方政治哲学的理想社会观

本文以马克思主义理想社会观对西方政治哲学的理想社会观进行了评析,认为西方政治哲学的价值理性主义和人文主义是构建理想社会的政治思维,理想社会体现了智性主义和人文主义的政治传统,理想社会建构关注财产关系的安排,制度主义是西方政治哲学理想社会的生长点.     

废除死刑是我国融入国际社会的必由之路

死刑是剥夺人的最基本的权力—人格权、生命权的法律制度。“死刑存废之争”由来已久。废除死刑是文明社会的共识和当今世界发展的潮流。目前,中国废除死刑的要求非常迫切,从法律的角度看,中国只有废除死刑才能更好地融入国际社会。     

Judging childhood

This article brings ethnohistorical inquiry to bear in exploring the certainties of Progressive Era reformers regarding the role of the state, the meaning of childhood, and the power of intervention in the lives of children, youth, and families in Butte, Montana. The author draws on the key themes of the Just Practice perspective (Finn & Jacobson, 2008)—as an organizing frame to explore assumptions and contestations regarding childhood, well-being, trouble, and intervention as expressed through primary source documents and reports of juvenile court proceedings in Butte from 1900 to 1914. Butte, a site of rapid industrialization at the turn of the last century, provides a local context in which to examine ways these certainties were asserted, negotiated, embedded, and resisted in the making of a nascent system of child welfare and juvenile justice. The historical analysis offers a foundation for critical reflection on the certainties embedded in contemporary practice with children and youth.     

Intelligent scheduling model and algorithm for manufacturing

This paper puts forward an intelligent scheduling model based on Hopfield neural network and a unified algorithm for manufacturing. The energy computation function and its dynamic state equation are derived and discussed in detail about their coefficients (parameters) and steps (Delta t) in iteration towards convergence. The unified model is focused on the structure of the above function and equation, in which the goal and penalty items must be involved and meet different schedule models. The applications to different schedule mode including jobshop static scheduling, scheduling with due-date constraint or priority constraint, dynamic scheduling, and JIT (just in time) scheduling are discussed, and a series of examples with Gantt charts are illustrated.

宋代不仅“户绝”有遗嘱继承,而且“非户绝”也同样存在遗嘱继承。《清明集》中记载的大量关于遗嘱继承纠纷的案例,实证了宋代遗嘱继承绝非个别现象,并非局限于“户绝”,而是已成为当时的一种普遍现象。与前代相比,宋代遗嘱继承制度进一步得以完善和规范化,并具有自身的特点,表现在其一直处在不断变化和调整之中,在司法实践中形成了一套行之有效的调解遗嘱继承纠纷的原则和方法。

新时期见义勇为价值系统的失调与重建

见义勇为是社会主义核心价值观的应有之义,但现在很多人"不愿"甚至"不敢"见义勇为。其原因在于:多元观念对个人价值的冲击,思想舆论争论造成价值判断模糊,保障制度滞后带来后顾之忧,法律制度缺乏导向力量。见义勇为价值系统重建需要我们以发展的观点来认识转型期的"道德阵痛",建设人文化的法律环境,完善社会保障制度,充分审视传统价值,利用好新媒体,促进见义勇为价值深入人心。     

论正当防卫与防卫过当的认定——邓玉娇事件引起的思考

如何正确适用正当防卫,充分发挥正当防卫制度的作用,是我国刑法的正当防卫制度得以全面落实的关键。这就要求我们在实践中,厘清正当防卫与防卫过当两个既有本质区别又有密切联系的概念。而如何把握好正当防卫与防卫过当的认定问题,法律没有规定具体标准。因此笔者希望通过案例分析防卫行为是否明显超过必要的限度,造成了重大损害为标准来评定。
