财物是否是遗忘物,不能根据财物的民法属性予以判断,而是应该考察案件的具体情况,结合财物本身的性质、放置的地点、时间等各种要素,根据人们的日常生活观念予以判断.委托物如果是封缄物,其占有归属不能仅仅根据自然事实,认为属于受托人,而应该注重封缄的目的性,认为占有属于委托人,无论受托人占有内容物还是整体物,都构成盗窃罪.盗窃罪以非法占有目的为必要,其内容为排除他人占有,并且按照财物的经济用途或者可能用途利用他人的财物.  相似文献

在我国司法界中探望权的执行存在着一定的难度。由于探望权执行表现为一种需要长期反复的行为,其执行的对象又是特定的相对人,并且需要多方配合才能实现,这就增加了执行的难度。要完善这一立法,应从其性质入手,深入分析在执行中遇到的问题及相应的解决方法,并借鉴他国经验,从而完善我国探望权的执行。  相似文献

Social workers acknowledge that they bring more than their professional skills and knowledge to practice, hence the emphasis in many social work programs on enhancing students' self knowledge. After a general overview of self‐knowledge activities for students, the gap between insight and practice is highlighted. The empirical literature is reviewed to find specific and purposeful self enactments, defined as functional ways in which workers intentionally apply their self to practice. Located within professional boundaries, such self enactments potentially form the basis upon which students might consider how to apply their own personal self.  相似文献

This article examines macro-structural conditions that affect time trends in aggregate probabilities of undocumented alien apprehension along the Mexico-US border. We show that the number of migrants attempting to cross the border illegally in a given period and the level of effort expended by the INS to apprehend undocumented migrants are principal determinants of apprehension probabilities. Our findings differ from those in earlier work by Donato, Durand, and Massey who argue that individual, household, and community factors are not significant predictors of apprehension probabilities and conclude that escaping INS detection at the border is essentially a random process unrelated to personal traits or to enforcement provisions of the 1986 Immigration Reform and Control Act. Although Donato et al. recognize that apprehension probabilities are affected by the size of the US Border Patrol budget and the number of personnel, they omit these larger structural factors from consideration. Instead, they introduce annual dummy variables to control for macro-structural forces. This approach is unsatisfactory because it confounds the effects of numerous explanatory factors. We conclude that one implication for future research is that it is worth modeling the effects of individuals' characteristics on apprehension probabilities by including as predictors an estimate of the flow of undocumented migrants and measures of INS border enforcement effort. Controlling explicitly for three macrostructural conditions may disclose the importance of some individual-level factors that would otherwise be obscured.  相似文献

ABSTRACT

The Social Workers Registration Bill 2018 is before the Parliament of South Australia. It makes provision to establish a social worker registration board with powers to investigate complaints and enforce penalties for breach of competency and ethical standards. This paper presents an argument for the national registration of social workers; and in addition, outlines key considerations for thinking about risk, protection, safeguarding, and implementation that comes with registration.

IMPLICATIONS
  • Risk and protection need to be assessed as part of a more comprehensive regulatory framework in the debates of registration.

  • If registration is to become part of the regulation of social work, a national approach to social worker registration is indicated, so that a person deregistered in one state cannot be employed as a social worker in another.

  • Social worker registration is a potentially useful formal mechanism that offers both a protective safeguard (social worker status) and a corrective safeguard (limiting or de-registering).

A small-scale survey was carried out on the health needs of those members of the Findhorn Bay Community, in northeast Scotland, who were over the age of 60. The survey asked questions about their health, quality of life, support received and perceived needs in these areas. The responses of the elders are summarised and discussed. Most of the elders had health conditions which affected their quality of life, yet almost all were satisfied with the support they received and over half with their quality of life. Implications for the links between community, family, work and perceived health were identified. Une recherche a ete faite sur les besoins en sante des personnes ages de plus de 60 ans qui vivent dans la communaute de Findhorn Bay dans le nord est d'Ecosse. Il y avait un questionnaire qui leur demandait des informations sur leur sante, et qualite de vie; il leur etait aussi demande si ils se sentaient suffisamment soutenus et comment ils percevaient les differents besoins de leur vie. Les responses de les personnes sont brievement evoquees et discutees. Les implications concernant les rapports entre communaute, famille, travail et sante furent identifiees. La plupart d'entre eux avait des problemes de sante qui affectaient leur qualite de vie, cependant la majorite etait satisfaite du soutien recu, et plus de la moitie avec leur qualite de vie.  相似文献

相对集中行政许可权是我国《行政许可法》确立的一项旨在解决我国传统行政审批制度弊端的法律制度。该项制度的确立,对目前形势下改革我国现行行政许可体制,建立新的运行机制,促进行政执法体制改革具有重要的作用。但该制度在本质上和一些法律原则存在一定的冲突,这决定了它生命力的阶段性。目前该制度在实践中也存在一些难题,需要进一步研究解决的方法。  相似文献

推进依法行政、建设法治政府必须正确理解行政执法的目的和功能,正视行政执法主体与行政相对人的关系,创新行政执法方式,革除行政执法实践中存在的执法权力行使分散化、执法活动运动化、执法手段单一强制化的弊端,使行政执法方式向综合化、常态化、民主化转变。实现这一转变的根本保障在于观念更新、体制创新和人的素质的提升。  相似文献
