流浪儿童救助保护体系的构建原则

当前,中国流浪儿童救助保护的理论与实践都取得了显著进展。然而,在这一领域中,国家——社会关系、体制内的机构救助者和民间主体如何分工、两者关系如何调适等方面尚未形成学界共识。因此,对中国流浪儿童救助保护体系的构建原则进行讨论很有必要。构建流浪儿童救助保护体系应包括五个原则,即政府依然要扮演主要角色、社会力量的有效参与不可或缺、专业社会工作与本土社会工作相结合、档案管理与因人施“救”、对流浪儿童实施主动性救助保护等方面。     

拯救辩证法还是消解辩证法——与田海平、马英林二先生商榷

一个半世纪前,马克思提出要从黑格尔哲学的神秘形式中把"一切辩证法的基本形式"解救出来。一个半世纪后,田海平、马英林二先生在《拯救辩证法:后形而上学时代的思想任务》一文中,重提"拯救辩证法"这一课题,对当代的辩证法研究是一个极大的推动。马克思的哲学研究,不仅有效地拯救了以黑格尔为代表的思辨辩证法,而且卓有成效地创立了合理形态的辩证法。但是,田、马二先生却认为,马克思的工作只是拯救辩证法这一"漫长旅程的开端或开始",而更重要的任务乃是进一步从形而上学的思想谱系与现实运作中"拯救"辩证法,并且认为,这是"后形而上学时代的思想任务"。不难看出,田、马二先生的"拯救辩证法"与马克思的"拯救辩证法"是根本不同的:马克思的拯救辩证法,是剔除神秘主义的思辨形式,救出"一切辩证法的基本形式",其结果是救出了辩证法;而田、马二先生的拯救辩证法,则是只保留辩证法的批判本性,而否定辩证法的形而上的本体论意蕴,从而否定一切辩证法共同具有的"基本形式",其结果是消解了辩证法。     

北极理事会的改革与变迁研究

2011年北极理事会的努克会议是北极治理的里程碑,会议通过了有约束力的《北极搜救协定》,并且对如何北极委员会做了一些初步的实践。北极理事会的发展变迁与改革,是在北极地区自然环境、国际政治环境、北极地区在北极国家国内政治地位等方面的变化过程与压力下实现的。未来北极理事会将朝向"硬法"性、以及加强制度建设等方面发展,但采取更为开放的姿态接纳观察员以应对全球问题对北极地区的挑战是北极理事会改革应有的方向。     

Rescue Fantasies in Child Therapy: Countertransference/Transference Enactments

When the focus of the child treatment is on the therapist being a good object, this can accentuate a possible countertransference difficulty of the therapist becoming the protector of the child from the bad object. This countertransference can often resonate with rescue fantasies in the child. This paper will explore the topic of rescue fantasies in child treatment, while addressing the issue of coinciding fantasies existing unconsciously in both the therapist and child, leading to their enactment. A case of a nine-year old boy is presented which demonstrates how interpretation and resolution of rescue fantasies can lead to a deepening of the treatment.

严歌苓的小说《人寰》改名《心理医生在吗？》重新出版,这一重新命名传达了丰富的文化信息。它表明该小说不仅是一个关于“病的隐喻”的文本,也是海外华人作家关于文化身份建构的实验文本。小说呈现了严歌苓作为海外华人作家向“他者”寻求文化“疗救”的努力和思考,并试图从“言语一权力”关系中透视历史深处,这正是小说的深刻之处。     

Occupational stress, rescue workers and English law

This paper shows how two strands of English case law, one establishing liability to compensate for shock suffered by those at the scene of disaster, and the other concerned with physical injury suffered by rescuers, were brought together in the 1960s to provide a remedy for a rescuer suffering from what the law describes as 'nervous shock'. It further traces the development of employers' liability in this context, but finds that the law provides few examples of the contractual duty of employers to protect employees generally against stress that may cause psychological injury. It points out that there is no case law on the liability of employers for stress suffered by rescue workers, whether professional or otherwise. It notes that law reports give little guidance as to the medical evidence judges require to persuade them that nervous shock has been suffered. Finally, it spells out that EC-inspired regulations could now be used to require employers to assess, and take steps to control, stress to which their employees, including rescue workers, are exposed.     

暴力恐怖事件的行政救助机制研究

政府对暴力恐怖事件中的受害人及其近亲属施以行政救助在实践中已经存在,但在现实中却缺少法制的考量:一来无明确的法律规范,欠缺法定的义务来源;二来无相应的具体制度和应急机制,无法保证救助行为的有效落实。面对现实与理想、实然与应然之间的巨大反差,行政法学界有必要对我国暴力恐怖事件中的行政救助进行适当的质疑与反思:质疑其是否有存在之必要,反思其是否有改进之方法。如此,方能使法治理论契合现代社会发展之迫切需要,以突显法学作为一门社会科学的价值意义和实践精神。
