香港将于一九九七年七月一日回归中国。九七前后香港法律的如何衔接，关系到香港平稳过渡的大局。九七之后香港法律的发展，关系到香港经济发展的状况。作者尝试勾划一个理论框架，作为研究、探讨香港法制发展问题的工具。     

Girl adoption in China—A less-known side of son preference

In 1987, 4 per cent of girls were adopted within China. Why? Unlike infanticide, abandonment rids parents of daughters while preserving the supply of potential brides. In fact, an erstwhile tradition common in Fujian and Jiangxi provinces had parents of sons adopting an infant girl to serve as a future daughter-in-law and household help. Analysing a nationally representative 1992 survey of children, we found that: (1) girl adoptions were concentrated in the above-mentioned provinces; (2) girls were predominantly adopted by families with sons; (3) adopted girls faced substantial disadvantage as measured by school attendance at ages 8–13. In the 1990s, as the sex ratio at birth climbed, were girls aborted rather than abandoned? Observing that in the 2000 census too many girls appear in families with older sons, we estimated that at least 1/25 girls were abandoned in the 1990s, a proportion that in Fujian and Jiangxi may have peaked at 1/10 in 1994.

从实然的角度讲,现行刑法中重婚罪的主要法益是配偶在夫妻关系中要求对方忠实于自己的权利,次要法益才是一夫一妻制。被害人承诺配偶重婚的,重婚行为不构成犯罪。前后都是事实婚姻,不构成重婚罪。重婚罪是即成犯,追诉时效从犯罪成立之日起计算。现行刑法中遗弃罪的法益是需要扶助人的受扶助的权利,对象不限于家庭成员。妨害婚姻、家庭罪整体搬迁弊多利少。     

从“弃尸”现象看死亡后的尊严问题

围绕近几年我国出现的＂弃尸＂现象,从生命伦理和法律的视角分析人类尸体被丢弃所带来的伦理道德问题,进一步论证人类尸体应该分享人类的一部分尊严,应该享有一定的道德关照地位这一核心观点,以此唤醒人们对自身尊严的道德意识,强化家庭、社会对处置人类尸体的道德责任,遏制＂弃尸＂现象在我国的频发。     

论宗教疏离美学的一面

宗教与美学有亲缘关系,但宗教也有疏离美学的一面。其根本原因是宗教信仰赖以发生的虔诚心理不能容纳审美活动必需的自由创造精神;其具体表现一是宗教戒律和宗教禁欲主义遏止了审美情感和审美体验,二是人为宗教反偶像崇拜的主张破坏了审美活动必不可少的形象直观性,三是被宗教畸形驭使的理性思辨阻碍了审美-艺术思维的发展。     

论中医实验对传统思辨方式的扬弃

中医思辨表现为注重和谐,注重事物间的关系,并利用事物表面联系找出解决问题的方法;而实验医学则不然,它是要尽量割裂研究对象与其它事物之间的联系,让实验在不受干扰的情况下进行。所以中医建设实验科学的第一步是要认识到哲学思辨与科学思维大不相同,在实验过程中应该慎用推理,并且对传统思辨的方法保持警惕。另外,思辨方法能够从正反两方面提出问题,在实验工作前仍然有积极意义。     

Finding ways (and words) to move: Mad student politics and practices of loneliness

Abstract

By blending the conceptual frameworks of epistemic injustice and ethical loneliness and applying them to campus-based practices of ‘risk’ identification and ‘referral’, this article describes how Mad students come to be abandoned as knowers and learners. I then dwell in and politicize the condition of (ethical) loneliness these harms produce by seeking to ‘practise’ it as a form of Mad knowing, and as a framework for visioning justice. Framing Mad student experiences in this way opens up several possibilities for epistemic justice. First, it offers additional language and interpretive resources for naming and protesting our experiences of violence. Second, it compels us to understand and attend to Mad student experiences of epistemic harm and to recognize how Mad knowledges are routinely generated in their wake. Third, it invites new ways of understanding and responding to these harms, and imagining redress.     

资产质量、实物期权与价值体现

依据实物期权理论,以2010年至2013年中国A股上市公司为研究样本,按是否属于ST公司和资产质量得分的十分位数对样本进行分组,研究资产质量得分及其特征对企业价值的影响,进一步使用Vuong检验分析不同组别样本公司资产质量特征表现在价值体现形式的差异性.研究结果表明,不同资产质量的公司具有不同的实物期权类型,资产质量高的公司体现出增长期权价值,而资产质量低的公司体现出清算期权价值.处于成长期的企业,资产的盈利性占主导地位;严重价值毁损的企业,资产的获现性发挥主要作用.中国资本市场整体处于价值增长阶段,但部分经营状况恶化的企业影响了市场的发展,该结论为上市公司退市制度提供了直接证据支持.     

Protagonists' and Adoptive Process Representations in Italian Children's Books About International Adoption: A Qualitative Study

This qualitative study aims at identifying the main representations of the international adoption process through a comparative analysis of 62 Italian stories about international adoption. Content analysis involves the use of thematic analysis as well as computer-assisted text analysis. Results show that adoption is represented varying from a polarization in which “the positive” is situated in the “adoptive world” while “the negative” pertains to the world of the origins, to a more integrated representation in which both the adoptive context and the origins entail positive aspects.
