论电子证据的法律地位

随着科学技术的进步和计算机的广泛运用 ,电子证据在刑事诉讼活动和证明过程中占有日益显著的地位。作为对新生事物的关注 ,我国法学理论界对电子证据的法律地位、种类归属及证据力等问题的研究在近年内也缓慢起步。因此 ,当前有必要从电子证据的收集与提取、资格与归属、认证与证明力各环节出发 ,对电子证据进行更加深入的理论分析和探讨 ,从而作出新的立法构想与安排 ,以弥补旧有制度的缺陷 ,并适应社会进步和国际发展趋势。     

运用作业成本法进行客户盈利能力分析的思考

不同的成本计算方法导致不同的成本计算结果，并影响到客户盈利能力的评价结果。传统成本计算法掩盖了客户盈利能力的真实信息，而作业成本法通过区分直接成本和间接成本，找出间接成本的成本动因，将间接成本依据成本动因追溯到特定客户，提高了客户盈利能力评价结果的可靠性。按照作业成本法的基本原理，推导出客户盈利能力分析的基本流程和成本计算模型，再通过实际案例说明其具体过程，并讨论了作业成本法在企业客户管理方面的实践运用。研究表明，作业成本法较之传统成本法明显提高管理者在分析客户盈利能力时的准确性，为制定客户管理决策提供科学的参考。     

精义复隐赋才流:庾信《哀江南赋》中的萧纲叙述

梁武乱政,侯景反噬,萧纲惨遭篡弑,令人同情;而其和同无方,常怀妥协,于家国丧败,无所用力,又令人扼腕.回视当时人的追叙文本,《哀江南赋》中的萧纲形象颇为模糊,几乎淹没于家国丧败和才士流离的典密叙述中,却又多层互写,精义复隐,史识文心俱在.即此可窥庾信“春秋左传学”一斑.     

地下空间的软导向识别及主要设计策略

针对软导向设计具有改善用户在特定导向任务中的寻路效率和效果的假设,利用意向尺度法对包含软导向设计的空间和不包含软导向设计的空间进行对比调研。结果证明,软导向设计可以明显提升导识效率,并发现随着用户对空间熟悉程度的增加,一些地标性差异物可以成为用户稳定可靠的定位要素,从而对常规标识系统的依赖度逐渐下降。由此提出应通过色彩和光影变化、立体造型与显著空间标志物的设置、平面造型的图案规划与差异、材料和肌理以及装饰强度的对比等措施完成空间中的软导向设计。并认为软导向设计前期需要在充分调研的基础之上开展,在设计过程中不但要节制规范的使用软导向要素,还应与空间主题语境相呼应。     

Consumption Dynamics During Recessions

Are there times when durable spending is less responsive to economic stimulus? We argue that aggregate durable expenditures respond more sluggishly to economic shocks during recessions because microeconomic frictions lead to declines in the frequency of households' durable adjustment. We show this by first using indirect inference to estimate a heterogeneous agent incomplete markets model with fixed costs of durable adjustment to match consumption dynamics in PSID microdata. We then show that aggregating this model delivers an extremely procyclical Impulse Response Function (IRF) of durable spending to aggregate shocks. For example, the response of durable spending to an income shock in 1999 is estimated to be almost twice as large as if it occurred in 2009. This procyclical IRF holds in response to standard business cycle shocks as well as in response to various policy shocks, and it is robust to general equilibrium. After estimating this robust theoretical implication of micro frictions, we provide additional direct empirical evidence for its importance using both cross‐sectional and time‐series data.

诏令是以皇帝名义颁布的命令文书的统称,是带有法定权威性与强制执行性的国家下行公文。诏令体制在汉代正式确立,在此之前,命令体制经历了一番由口头下达到书面形式命令的漫长发展过程,亦为诏令体制的确立奠定了基础。作为皇帝发号施令的载体,诏令类文体在演进和发展过程中,其名称也随之经历了一个由模糊到精确的过程。     

Indirect membership function assignment based on ordinal regression

In many fuzzy sets applications, fuzzy membership functions are commonly developed based on empirical or expert knowledge. The equation of a membership function is usually determined somewhat arbitrarily. This paper explores a novel membership function design method based on ordinal regression analysis. The estimated thresholds between ordinal measurement categories are applied to calculate the intersection points between fuzzy sets. These intersection points are further applied to determine the equations of the membership functions. Information distortion due to empirical guess can thus be reduced and more latent information in the fuzzy responses can therefore be captured. A case study investigating the relationship between foster mothers’ satisfaction and the foster time and information provided has been conducted in this research. The applicability and effectiveness of the proposed membership function assignment approach have been demonstrated through several case studies.     

略论非法行医罪的主观方面

通过我国刑法的罪过理论分析,认为非法行医罪的基本犯罪的主观方面为故意,包括间接故意,并不要求牟利的目的的理解,才符合我国现行刑法的规定。并且,认为本罪的结果加重犯的罪过形式为典型的复合罪过,即过失和间接故意,并给出了自己的理由。
