提单是重要的航运单证。实践中经常出现托运人为了结汇需要,在出具保函的条件下,要求承运人按其要求填写记载事项,此时就会出现提单的记载事项与实际情况不符的矛盾而引起争议。对提单记载事项的文义性与要式性、证据效力、提单正面记载事项与背面条款冲突时效力的认定以及与舱单记载的关系等进行研究。

Moby-Dick and the American Empire

Abstract

This article explores the parallels between the narrative tropes of Moby-Dick and the conduct of the Mexican War of 1846–48. Drawing on the theories of Austin and Butler, the article develops an account of the performative speech acts deployed by President James K. Polk in order to secure Congressional support for the war, and the rhetorical power exercised by Ahab on the Pequod. It also examines in detail Melville’s use of the Biblical figures of King Ahab and Belshazzar, showing how the novel turns the Biblical-republican typology used in the American Revolution against the British to indict America’s own practice of imperialism. The article concludes by reflecting on both the vision of perpetual war which Melville presents as the consequence of Polk’s assumption of imperial power, and the parallels between Polk’s prosecution of the war with Mexico and the US invasion of Iraq.     

Making autism through Ocean Heaven (海洋天堂, Haiyang tiantang) and the possibilities of realizing disability differently

This article focuses on a filmic portrayal of issues relating to autism in a Chinese context, using this as a prism through which to consider how meanings associated with disability in general, and the autistic spectrum in particular, are produced. Instead of perpetuating a reductive positive/negative approach to representation, the article focuses on the fluid and dynamic ways in which author and audience co-produce texts relating to disability in ways which are invariably influenced by, and reproducing of, specific socio-cultural and discursive circumstances. Meaning-making in relation to disability is, however, ongoing and there is potential to realize disability differently.

Manifest destiny,American exceptionalism,and the city on a hill seen through Winthrop,O'Sullivan,and Bush: Opportunities for religious peacebuilding

A dominant theme in the story of the American, city-on-a-hill experience is manifest destiny, a term literally expressing a sense of a rightful, westward expansion across the continent in the late 19^th century, but more broadly expressing a general entitlement granted, it is often understood, divinely to an exceptional United States of America. The origins, the political-versus-religious undergirding, and the implications of manifest destiny are widely discussed in the literature. Here I focus on three primary texts by John Winthrop, John O'Sullivan, and George W. Bush to argue that, even though Winthrop's and his fellow Puritan immigrants' understanding of their role in the new land was a far cry from that of O'Sullivan—who coined the term “manifest destiny” – the seeds of manifest destiny were brought with these first immigrants to the Massachusetts Bay Colony, later sprouting and blossoming in O'Sullivan's coining, and eventually bearing some of its many fruits Bush's foreign policy. Finally, I will discuss the sociological and other implications of the divine endorsement of such ideas.

语用失误的认知分析——语用失误与认知语境研究之假设观

语用失误的研究一直以来就是国内外语言学界研究的热点。以往的大部分研究多局限在语言表达与文化，习俗和礼貌等不相适应的文字表征层面，文化差异经常被归结为语用失误的根本原因。目前对语用失误的认知探讨还不多。以宏观的认知语境为理论框架，对交际中的语用失误现象重新进行认知的界定和阐释。语用失误现象的形成主要是因为交际双方的假设不能互明或假设的关联环节出现问题。
