页岩气开发环境风险的法律规制思考

目前，我国在页岩气开发的环境保护方面存在着大量的法律空白，往往只能参照环境保护法和矿产资源法中的相关规定进行规制，无法有效解决页岩气开发暴露出来的环境问题。页岩气开发环境风险的法律规制，核心目的就是解决当前页岩气开发中的环境风险，促进页岩气开发与环境保护相协调，实现能源开发的可持续发展。在页岩气开发环境风险的法律规制方面，英美两国已经探索出一些经验和制度。积极借鉴国外有益经验，努力改进和完善我国应对页岩气开发环境风险的法律规制，对实现我国页岩气开采的经济效益、社会效益和环境效益三者的统一具有重要的现实意义。     

“I feel and think,therefore I am”: An Affect-Cognitive Theory of management decisions

I propose an Affect-Cognitive Theory to comprehensively understand how decisions occur in organizations. To this aim, I first review the assumptions of sensemaking and decision-making streams of research, especially the influence of bounded rationality, affective states and their relationships with cognition; then, I integrate them on the common basis of socially situated cognition. This new theory emphasizes the role of affective states in determining/being determined by cognition and its errors, pointing out decision makers’ affect as the result of multi-level adaptations to the physical and social environment. Management decisions are path dependent but not immutable; they, indeed, bank on the predominant feeling resulting from the modifying interactions and regulations of decision makers with their physical and social environment. Here, decision makers are proposed as “emotional cognizers” overcoming the thinking-feeling dichotomy that has often featured in the study of management decisions. This theory is beneficial for behavioral strategy, offering the needed assumptions to intertwine human cognition, emotions, and social behavior.     

The impact of social power and influence on the implementation of innovation strategies: A case study of a UK mega infrastructure construction project

Influence plays a key role in reaching consensus among multiple actors involved in project-based decision-making processes. While prior literature devotes considerable attention to describing influence, little attention has been paid to influence at the individual level of the strategic project manager within the context of megaprojects. This research intended to fill this knowledge gap by identifying and describing the influence strategies that a strategic project manager applies when implementing innovation strategies on megaprojects. A qualitative case study was used to examine the complex social processes involved in a major UK capital investment programme. The findings underline a critical subset of influence strategies, notably higher-management support, inspirational appeal and bargaining. The study proposes a utilitarian structure of social power comprising selective, supportive and executory power bases.     

Comprehensive neighbourhood mapping: developing a powerful tool for child protection

This paper proposes ‘comprehensive neighbourhood mapping’ as a schema for gathering and interpreting information within a given geographical area which is informed by imaginative thinking about the safety of children and young people from sexual crime. It would build upon current forms of profiling by local authorities, health authorities and central Government. CNM would actively involve local people, in partnership with agencies, in ‘mapping’ danger points and support points. Eight components are discussed, including environmental issues, locations of sex offenders, sites where teenagers meet and share information, supportive individuals and organizations. Some issues for pilot projects are discussed, including the need to set up planning and implementation groups and to integrate CNM into wider child protection and community safety strategies. CNM is grounded in an ecological perspective which sees partnership approaches as essential and believes an overarching view of neighbourhood needs, based on detailed local information and understanding of how different forms of harm interconnect, is crucial in developing child protection strategies. At times of acute official anxiety about community ‘lynch‐mob’ reactions to known paedophiles, CNM aims to build communities which instead are informed and thoughtful about child protection. 论上市公司国有股减持对我国公司法的挑战

围绕上市公司国有股减持人们提出了许多方案。这些方案的实施对我国公司法上的小股东利益保护、公司治理及发起人股份转让限制制度提出了严峻挑战。我国公司法必须从建立系统的小股东利益保护法律制度、包括约束内部人控制和公司机关更迭衔接制度在内的公司治理制度和放宽发起人股份转让限制条件三个方面予以完善,才能应对挑战和保障国有股减持的顺利进行。     

更高层次的迈进——企业相对社会责任的实现

相对社会责任的承担与实现,对企业自身和社会都具有重大意义,但由于缺乏机制的制约和策略的应用,其实现是困难的。正确处理企业利益与社会责任的关系,促使更多企业从履行绝对社会责任,上升到追求更高层次社会责任的实现,一方面需要外在环境的保障,另一方面要求企业在履行社会责任时,注意策略选择。
