听证在公共政策选择中的作用

听证是现代公共决策的重要程序,对于促进和实现公共决策科学化、民主化和法制化具有重要意义.在政策选择中引入听证程序不仅可以有效抑制和防止政府自利性,解决政策制定中的信息不对称问题,而且可以广纳民意、争取民心,增强政策选择的合法性和有效性.

文学翻译中所讨论的"形似"与"神似"的问题在科技翻译中也存在。科技翻译应分两部分来考虑翻译原则:一部分是除核心词语以外的部分,这里基本不用考虑"形似"与"神似"的问题,译文只求"准确,易懂"。另一部分是核心词语的翻译,即新出现的科技词语的翻译。翻译核心词语的时候,译者应该尽量争取做到译文与原文不仅"形似",而且"神似"。

论审理医疗纠纷案件对美国法庭“专家证人制度”的借鉴——由中美两个案例比较谈起

近阶段,医疗纠纷冲突凸显,大量的矛盾往往最终汇集到法院。而审理医疗纠纷案件时,法官面临诸多法律困境,尤其是科学证据的采纳问题。分析认为,借鉴美国"专家证人"制度,人民法院应设立"专家辅助人",可以较为有效地解决这些问题。     

Perceptions of Domestic Violence in Lesbian Relationships: Stereotypes and Gender Role Expectations

In light of evidence suggesting that violence between lesbian couples is oftentimes dismissed as “mutually combative,” expectations that support this perception were examined. Participants (N = 287) evaluated a domestic violence situation within the context of a lesbian partnership. As physical appearance may be used to support gender- and heterosexist-based stereotypes relating to lesbians, participants evaluated a domestic violence incident wherein the physical appearance of both the victim and perpetrator were systematically varied. Overall, women perceived the situation as more dangerous than did men. However, among women, the plausibility of the victim's claim, and blame assigned to the perpetrator and victim, varied as a function of the physical appearance of the couple. Implications of this research as well as future directions are discussed.     

Liberated and Inclusive? An Analysis of Self-Representation in a Popular Lesbian Magazine

Comparisons of a popular lesbian lifestyle magazine to a popular heterosexual women's magazine show that lesbian-controlled media do indeed expand representation when it comes to weight, age, and degree of femininity/masculinity, but not in terms of racial representation. An examination of the textual material and visual images also shows that the lesbian publication gives women a more active role, while the heterosexual magazine depicts females as more passive. However, the evidence also shows that the lesbian and heterosexual magazines have similar rates of objectification, but substantively, the lesbian magazine is less severe in degree of objectification.     

Countertransference Bias: Self-Examination,Not Cross-Examination

ABSTRACT

In reply to T. Tippins (2007, this issue), we take issue with his claim that recognition of the biasing impact of custody evaluators' countertransference opens the door to “evidentially legitimate” fishing expeditions through evaluators' private lives on cross-examination. We clarify the distinction between self-examination for counter-transference bias as a heuristic for improving the sensitivity and objectivity of expert testimony and its use as substantive evidence. We argue that countertransference bias is a highly personal, emotionally charged kind of bias, unlike the cognitive biases more frequently discussed in the child custody literature. We conclude that recognition of the insidious emotional influences that threaten our objectivity in working with families in high conflict divorce is an important ethical responsibility.
