新时期监事会的业务监督——以中日两国董事义务为视角

我国公司法上的监事会，是对董事及高级管理人员的业务执行进行专门性监督的常设机构，该专门性监督能否取得实效将直接影响公司的经营绩效及利害关系人的利益，而明确监事会的业务监督权限是提高监督实效的关键。本文通过与日本法的比较研究，以2005年公司法增设的勤勉义务（Duty of Care）为焦点，对公司法修改后的股份有限公司监事会的业务监督范围及内容进行了新的解读与探索.     

How Autonomous are Public Corporations in Hong Kong? The Case of the Airport Authority

This article examines the degree of autonomy of Hong Kong’s Airport Authority (AA). Traditionally, airport management in Hong Kong was the responsibility of the government’s Civil Aviation Department. The AA was established in 1995 to manage the new international airport at Chek Lap Kok which opened in 1998. It was expected to run as a commercial enterprise but, because of its strategic importance, there was concern that it should not become an independent empire detached from government control. As a hybrid type of organization, the AA has moved steadily towards full commercialization. The government has also put its privatization on the agenda. Its transformation may have some implications for the redefinition of the future autonomy boundaries of public corporations in Hong Kong.

金融监管体系改革对商业银行的影响及对策

中国银行业监督管理委员会的成立，标志着我国银行监管体制的重大变革已进入具体实施阶段，银监会今后将加大对商业银行的监管力度和频度，这必将对商业银行的经营产生深刻的影响。在新的金融监管形势下，商业银行应按照有效监管的要求，达到合规经营和风险防范的长效管理，实现可持续发展。本文从分析我国现行的金融监管体制和商业银行现状入手，指出了金融监管体系改革对商业银行的影响并提出了相应的对策。     

情绪调节自我效能感量表的修订

文章严格按照量表修订程序对Caprara等人2008年编制的情绪调节自我效能感量表（SRESE）进行修订,分别选取192名和1691名中学生进行初测和正式施测,验证修订版量表的信度和效度。结果表明：修订后的量表内部一致信度为0．653～0．864,分半信度为0．602～0．740,建构信度为0．709～0．772;各条目一总分相关系数均有统计学显著性意义,CR值均达到显著水平;验证性因素分析支持二阶五因素模型。因此,认为修订后量表具有良好的心理测量学指标,可在中国青少年人群中应用。     

Probabilistic Risk Analyses: NRC Programs and Perspectives

The historical basis and more recent activities and products of probabilistic risk analysis (PRA) in the Atomic Energy Commission and Nuclear Regulatory Commission (NRC) are reviewed. Current NRC program activities and objectives are described. The author's opinions on the best uses of PRA are presented.     

基于调节焦点理论的领导对下属创造力影响机理研究

本研究从心理学的调节焦点理论切入,构建了基于调节焦点理论的领导对下属创造力影响机理模型。具体探讨领导的行为示范、语言框架及反馈,通过对个体调节焦点与群体共享调节焦点两个层面的共同引导,进而影响下属创造力的作用过程。本研究将丰富并厘清人们对领导提升下属创造力的影响路径与作用规律的认识,并为领导通过日常管理来激发下属创造力提供借鉴与指导。     

调节焦点视角下工作压力对员工创造力的影响

基于调节焦点理论,本研究探讨了促进型调节焦点在挑战性工作压力和员工创造力之间、防御型调节焦点在阻碍性工作压力和员工创造力之间所起的中介作用,并根据社会信息处理理论,进一步探究了参与型领导在此过程中的调节作用。通过对202份调查问卷进行统计分析,得出以下研究结论:(1)挑战性工作压力能够诱发员工的促进型调节焦点,阻碍性工作压力能够诱发员工的防御型调节焦点;(2)促进型调节焦点在挑战性工作压力与员工创造力之间起中介作用,即挑战性工作压力通过增强促进型调节焦点继而提高员工创造力,防御型调节焦点在阻碍性工作压力与员工创造力之间的没有起到中介作用;(3)参与型领导增强了挑战性工作压力与促进型调节焦点之间的正向关系,并在这个模型中起调节作用;(4)参与型领导削弱了阻碍性工作压力与防御型调节焦点之间的正向关系,但并没有在整个模型中起到调节作用。以上研究为"如何使员工在沉重的工作压力下提高创造力"等问题提供了一个新的解释,具有重要的理论和实践意义。     

论我国银行监管体制的完善--评《银监法》

随着金融发展的变化,各国银行监管体制不断演变.我国银行监管体制改革亦自<银监法>的颁布实施进入一个新的历史时期,银监会作为我国现在银行监管的国家监管主体资格及其职能有了法律依据.但是现有的银行监管体制与银监法所规定的还有一定差距,应当以银监法为蓝本,改革和完善我国的银行监管体制,适应金融发展的需要.     

The professionalization of the 'shoe clerk'

Summary.  The address reviews the professionalization of statisticians working in the regulated world of drug development. The need for statisticians to continue to push the boundaries of their professional environment is stressed. It is argued that to maintain the strength and influence of the profession it is neither desirable, nor necessary, to define in a statutory sense access to the profession.     

Social Work Registration: Another Opportunity for Discussion

ABSTRACT

The Social Workers Registration Bill 2018 is before the Parliament of South Australia. It makes provision to establish a social worker registration board with powers to investigate complaints and enforce penalties for breach of competency and ethical standards. This paper presents an argument for the national registration of social workers; and in addition, outlines key considerations for thinking about risk, protection, safeguarding, and implementation that comes with registration.

IMPLICATIONS

• Risk and protection need to be assessed as part of a more comprehensive regulatory framework in the debates of registration.

• If registration is to become part of the regulation of social work, a national approach to social worker registration is indicated, so that a person deregistered in one state cannot be employed as a social worker in another.

• Social worker registration is a potentially useful formal mechanism that offers both a protective safeguard (social worker status) and a corrective safeguard (limiting or de-registering).
