纠纷化解机制构建与征地程序改革

摘    要:运用比较研究和制度分析的方法,通过与发达国家征地程序中成熟而系统的纠纷化解机制的比较研究,透视了我国征地程序在预防和化解纠纷方面存在的缺陷。研究发现:我国征地程序在审批阶段缺少征地合法性实质审查和纠纷预防机制,安置补偿决定阶段纠纷化解机制不科学,安置补偿实施阶段纠纷解决机制薄弱。通过征地程序改革,建立以双方协商化解为基础,以中立的第三方协助化解为补充,以官方权威的强制化解为保障,三者密切衔接的征地纠纷预防和化解机制,是治理频发的征地冲突和构建和谐社会的迫切需要。

Abstract:Using comparative and institutional analysis theory , we comparatively analyzed the systematic and mature land expropriation dispute preventing and resolving mechanisms in developed countries , and examined the defects in Chinese land expropriation dispute preventing and resolving mechanisms .There are three defects in Chinese land expropriation dispute preventing and resolving mechanisms : lacking substantive censor of the legitimacy , the dispute resolving mechanism for placement and compensation is unscientific , and the mechanism for implementation of placement and compensation is weak .It's urgent to establish a dispute prevention and resolution mechanism combining the mandatory conciliation , the neutral third party who facilitates negotiations between the two parties , so as to construct a harmonious so-ciety.
