| 摘 要： | 认为现行婚姻法对探望权的规定有不少有待完善之处 ,主要体现在行使探望权的主体范围过小 ,也过于模糊 ;有关行使探望权的法律规定显失公平 ;对探望权的中止规定过于简单 ;对探望权的强制执行规定也有待完善。同时提出了改进这些规定的建议。

| Abstract: | This paper holds that there is much to be improved about the visitation rights in the existing marriage law. The imperfection is reflected in that: 1) the scope of subject is too narrow and not clearly defined; 2) some clauses about visitation rights appear to be unfair; 3) the clause about the abeyance of visitation rights is too simple; and 4) there is some problem in enforcing the mandatory provision. The paper also makes suggestions about revising these clauses. |
