排污权的经济法属性探析

为了厘清排污权的权利属性,采用比较的研究方法.在对排污权的概念和特征进行介绍的基础上,通过和民法上的人身权、财产权的比较分析,证明排污权不是民法上的权利.接着通过分析国家职能的转变和传统经济法的权利.证明排污权也不是行政法上的权利.最后从经济发展权着手,认为排污权彰显的社会与企业之间增量利益的空间上的普遍平衡和时间上的可持续发展价值,排污权兼具集体性和独占性,排污权是经济法上一种新的权利.

Attribution of Right to Discharge Pollutants in the Economy Law

In order to make the right of discharging of pollutants,the thesis proves that the former right is not a kind of civil rights by contrasting with the personal right and the property right of the civil rights.Then the thesis certifies that the right of discharging of pollutants is not an administrative right on the analysis of the trait of the function of the states and the rights of the traditional law.At last,embarking on the right of economy development,the thesis thinks that the right to discharge the pollutants manifests the universal counterbalance on the space of the increment between the society and the enterprise and the value of ever-lasting development on time.The right of discharging of the pollutants is characterized with both the collectivity and the monopolization,which is a new right in economy law.
