| 摘 要： | 船员外派企业在船员外派法律关系中起着必不可少的作用，在中国，无论是在相关立法还是司法实践中都赋予该企业船员用人单位的角色，而不只是为船员和外方雇主提供信息服务的居间人。这个问题的厘定可以充分保障外派船员的利益。

| Abstract: | A seamen manning agency plays an essential role in the assignment of Chinese seamen to foreign vessels.In China,both the legislation and the judicial practice assign such an agency the role of employer,rather than a mediator who only provides some information service to seamen and overseas employers in seamen manning.This legal status of seamen manning agency will safeguard the rights and interests of Chinese seamen providing service for foreign vessels. |
