| 摘 要： | 虽然德沃金这个原则理论的作俑者,最终放弃了原则理论,但是他更多是基于工具性的考量,主要是因为德沃金已经找到了更好批评实证主义的理论工具.不过,原则理论本身在法律概念的层面上的确存在严重的理论困难,因此无法成为有效的法律概念上的主张.不过,它在法律适用领域的存在还是有相当坚实的基础,因为它能够同时实现对于法律传统和道德正当性的双重尊重；而这一点,正是所有相关讨论所真正应当遵循的恰当道路.

| Abstract: | Dworkin eventually abandoned the principle theory, but it was mainly because Dworkin has found a better theory tool to criticize positivism. Principle theory itself in the legal concept level indeed has serious theoretical difficulties, therefore it cannot become the effective proposition for legal concepts. However, it has solid foundation in the application of law, because it can respect the legal traditions and the moral legitimacy at the same time, which is the proper path that all related discussions should follow. |
