| 摘 要： | 法和经济学作为一门学科，起源于20世纪60年代初。但法和经济学思想在中西方都可以追溯到很久远的年代。文章介绍了先秦时期、封建地主经济前期中国先哲们的有关法和经济学的思想，说明我们的先哲们所具有的法和经济学思想的历史要远远早于西方的法和经济学思想的历史，但无论是国外还是国内的有关法和经济学的文献中，都几乎没有提及我们的先哲们的法和经济学思想，这不能不令人遗憾和发人深思。
