| 摘 要： | 房屋征收是因公共利益对私有财产权进行限制,在这一过程中,不仅因为公共利益具有模糊性和容易扩张性的特点而使权利救济成为必要,而且在权利救济的过程中,不仅必须注意处理好权利救济与合理补偿的关系,还应处理好权利人的权利救济与其他相关主体的权利救济的关系。权利救济原则所针对的并不是权利的某一方面,而是在各方权利明确的情况下,通过救济权利的规定对所有的权利一致地进行保护。

| Abstract: | House expropriation is a kind of restriction of private property for public interests. During this process, right reliefe is necessity as public interest has the character of fuzziness and expansibility. Right reliefe not only includes reasonable compensation, but also includes the balance of the owner of property and other owners of rights. Right reliefe not only focuses on property owners, but also focuses on the equality of protect of all relevant rights. |
