| 摘 要： | 我国《婚姻法》有关结婚程序的规定中存在着法定登记制与世俗仪式制、自愿的婚约与必备的婚约的冲突。这些冲突实质上体现了传统法律文化与现代法律文化、观念性法律文化与制度性法律文化、中国法律文化与外来法律文化的冲突。要解决这些冲突，必须要遵循继承传统、借鉴西方，建立和完善有中国特色的制度性法律文化，并促进观念性法律文化现代化的思路进行。

| Abstract: | Concerning the procedures of our country's Marriage Law,we find that there exist conflicts between official registration and secular ceremony system,voluntary and necessary marriage. It reflects the conflicts between traditional and modern legal culture,conceptual and institutional legal culture,Chinese and external legal culture. To settle these legal culture conflicts in marriage procedures,we must follow and inherent traditions,learn from the West,establish and perfect institutional legal culture with Chinese characterized and promote the process of modernized conceptual legal culture. |
