| 摘 要： | 行政程序所具有的防止行政恣意和保证理性选择的特点，正好解决了行政合同不对等性可能带来的失控问题。因此，对行政合同进行程序控制是必要的，而且是可行的。着眼于行政合同程序的特殊性，对行政合同程序的特殊法律原则和制度以及一般程序原则和制度在行政合同领域的新的内涵，进行了论证。提出了自己的观点。

| Abstract: | The characteristics of adminstrative procedure to avoid adminstrative arbitrariness and assure rational choice just solve the problems of the adminstrative contract caused by unequivalency. So it is necessary and possible to control the procedure of adminstrative contract. With a view to the particularity of adminstrative contract procedure, this paper expounds the special legal principles and systems of adminstrative contract procedure,and also presents some viewpoints on the new implications of usual procedure principles and systems in the field of adminstrative contract. |
