问题与探索:评《民诉法修正案(草案)》对再审程序的修订

《中华人民共和国民事诉讼法修正案(草案)》对再审程序的修订,解决了民事再审程序中存在的一些问题,但仍有进一步探讨的空间:有关规定违反诉讼权利平等原则、再审检察建议的效力定位不明、当事人申请再审检察建议或者抗诉的情形有待商榷等。因此,建议删除违反诉讼权利平等原则的条款,取消再审检察建议或者明确界定其与抗诉的效力和适用条件,并将适用条件予以规范表述,从而促进我国民事再审程序更好的完善。

Problems and Exploration:Comments on modification of rehearing procedure in Amendments to the Draft of Law of Civil Proceedings

In the modification of rehearing procedure in Amendments to the Draft of Law of Civil Proceedings,some problems in rehearing procedure were solved,but it deserved further discussion: some provisions offend the principle of equal litigant right,suggestions for retrial and inspection position its function unclearly,the conditions in which the party concerned applied for retrial and inspection or counter-appeal need more discussion,etc.Therefore,the author proposed to delete the articles against equal litigation right,cancel the suggestion for retrial and inspection or define its force with counter-appeal and its application condition,express the condition with standard narration,thereby propelling the improvement of our rehearing civil procedure.
