| 摘 要： | 习惯法是一个可以描述的有机整体规范模式.文化模式影响个人的行为,现代习惯法规范是文化模式的基本构成要素,其影响个人行为的结果是形成法律多元现象.现代社会中,习惯法模式与国家法律的观念是小传统与大传统的关系.每种文化模式都有其价值,但也不能绝对化.法律为人们所信奉,就具有了"合法"性,本文从文化模式理论视角对我国的村规民约问题进行了分析.
