| 摘 要： | 庞德的社会学法理学在整个法理学界产生了极为深远的影响,但作为其理论基础的利益学说却鲜有人进行专门的论述.庞德的利益学说是其社会控制论的基础,利益是其社会控制的任务.他将利益分为个人利益、公共利益和社会利益,并以最小的利益牺牲达到利益的最大化作为利益冲突时衡量的标准.通过对庞德利益学说的理论框架与可能限度的剖析,我们发现,其利益理论对平衡现行社会中各种利益关系进而达致良好社会秩序具有重要的现实意义.
