集权制政治与现代法制之关系研究

在现代法制社会 ,法律的基本作用被认为是约束与限制权力 ,而集权制政治的权力基础却来自内部 ,来自于领袖或一党制中的政党的威望或影响 ,社会环境包括法律制度对这种权力系统的影响微乎其微。因此 ,集权制政治与现代法制在本质上是不相容的 ,但两者之间的关系却错综复杂。一方面现代法律制度的建立对传统权威有依赖作用 ,另一方面现代法律制度有助于现代法律文化的形成 ,而现代法律文化是对传统权威的一种挑战 ,现代法律制度还为集权制政治的改良提供了一种可能的途径。同时提出 ,解决目前我国政治体制的根本途径在于发展社会主义民主。

The Relation of Centralism and the Modern Democracy

In the modern democracy law acts a role of regulating authority, and yet the source of centralism authority is not law but tradition, So centralism and the modern democracy aren't compatible. But the relation of centralism and the modern democracy is very intricate. Centralism is beneficial to the generation of the modern democracy, at the same time the modern democracy promotes betterment of centralism. This article still tries to express the author towards the problem of China political reformation.
