| 摘 要： | 在我国有一部分学者不认同我国古代存在独立的商事法律制度。本文以两个部分，分别阐述了我国古代商事法律制度形成的社会历史条件以及我国古代商事法律制度的独立性及其渊源，以期澄清现代社会对我国古代商事法律制度的误解。

| Abstract: | Some scholars in our country do not agree with the independent commercial law system in ancient China.In this paper,the two parts,the social and historical conditions of the formation of China's ancient commercial law system,and the independence and the origin of the ancient commercial law system,in order to clarify the misunderstanding of the modern society of China's ancient commercial law system. |
