违反安全保障义务侵权责任研究

安全保障义务具有多重性质。不仅包括法定义务,也包括约定义务和合同的附随义务,安全保障义务的性质不同,产生的法律责任也不同。安全保障义务的主体不仅仅限于经营者和社会活动的组织者,开启公共交通的人、实施了先行危险行为的人、实施职业活动的人和在婚姻家庭中有密切关系的人都应当承担安全保障义务。这些开启或制造了危险的人,应该对他人因此而受到的损害承担侵权责任。
