| 摘 要： | 中外自然法思想的发展都为人权保障奠定了根本的理论基础.该理论基础表现在两个基本方面:一方面主张法不仁不可以为法的改造人为法的先理后法原则;另一方面主张在人我关系领域以自存为原初目的强调人格尊严的个人本位主义。

| Abstract: | The development of natural law thoughts both at home and abroad has laid a solid theoretical foundation for human rights protection, which may well be argued for from the two perspectives given below: the first is the standing of preferring reasonableness to legitimation as means of modification to non-humanistic man-made law; the second is the advocating of individualism for the primitive purpose of existence and dignity in human relations. |
