| 摘 要： | 中国劳动教养制度在维护社会稳定与社会秩序方面曾经起到过积极作用,但因其内在的固有缺陷对公民基本人权也造成一定的侵犯。随着法治中国建设的持续深入发展,劳动教养制度不仅与我国宪法法律的人权保障要求相背离,而且也与国际人权公约的规定相冲突,废止劳动教养制度并进行相应的制度改革,就成为我国法治建设与人权保障事业发展的必然要求。

| Abstract: | China＇s reeducation through labor system has ever played a positive role in the maintenance of social stability and social order .But its inherent flaws have to some extent caused infringement of citizens＇basic human rights.With the development of the rule of law construction , the system of reeducation through labor not only devi-ates from human rights protection stipulated by the constitutional law , but also conflicts the provisions of the interna-tional convention on human rights .Therefore , it is essential to abolish the reeducation through labor system and re-form the system in the progress of legal construction and human rights protection in China . |
