| 摘 要： | 如何有效地对性交易活动进行法律治理是世界各国的一个难题，我国亦面临同样的问题。我国早期制定的对性交易及相关行为的法律条文随着当时立法的社会背景的变化，已不能适应当前新的情况。本文在比较国外的立法和实施效果并结合我国的实际状况基础上，对性交易行为的法律性质进行客观分析，就我国现行有关性交易的立法方式和内容提出了新的观点，强调应采取购买性交易一方施以处罚的立法模式，并提出了具体措施以实现更好地利用法律手段有效控制性交易活动的目的。

| Abstract: | How to effectively carry out sex trading activities on the law of governance is a problem all over the world. China is also facing the same problem. As the social background of the legislative changes, China＇s early formulation of the sex trade and related provisions of the law acts can not meet the current new circumstances. Comparing the foreign legislation and implementation effect in combination with the actual situation of our country and based on an objective analysis about the sex trade legal nature, this paper put forward a new viewpoint for our existing legal way and content on sex trade, stressed that the purchase of the sex trade should be taken to punishment, and gave concrete measures to achieve the purpose of effectively controlling of trading activities by better use of legal means. |
