司法的商品属性:一个认识和研究司法的新视角

在西方,以国家权力为视角研究司法存在的局限性,故有必要发现并承认体现司法平等、公开、公平、廉洁、观念更新等诉求的司法商品属性,这对于深化对司法运行规律的认识具有重要意义。司法价值取决于法院制度机制是否健全及法官是否专业清廉高效,其交换价值受供求关系、诉讼当事人主观意愿、司法产品实际效用的影响。而司法使用价值的大小则受制于诉讼当事人收入水平、人们对司法评价的扩散效应以及司法与相对物的比较情况。

In the west, the theories of understanding and studying justice by the angle of state power havea number of limitations.So we need to rediscover and recognize commodity attributes of justice. The judicial commodity attribute also reflects the judicial equality, open, justice, integrity, updating concept demands; it is of great significance for deepening the understanding of the judicial rules. The value of justice depends on improvement of court system and the judge’s profession, incorruptness and effectiveness. The exchange value of justice is affected by supply-demand relation, litigant’s subjective views and actual utility. Useful value of justice in people’s consciousness is often subject to the litigant’s income levels, diffusion effect of judicial evaluation and comparing with counterpart.
