生态权利观的多元聚焦与差异整合

环境法学不仅视生态权利为人权的组成部分,也把它当做生态社会中其他权利的基础。生态政治以社会正义为核心价值观,强调了以广泛的权利为前提的个人和社会的生态责任。生态哲学所强调的生态权利是以认同自然界的权利为基础的人的权利。多元生态权利观的差异主要表现在生态权利的对象性规定、生态权利的主体性界定、生态权利的代表权确立等几个方面。只有回到生态权利的原始发生地,通过对生态权利观的根源分析,才能整合观念差异,以获得共同同意的、从而具有普适性的生态权利观念。
