摘    要:《劳动合同法》是一部关系到我国能否建成和谐社会的法律,因为大部分公民都与用人单位存在着劳动关系。随着《劳动合同法》以及《劳动合同法实施条例》实施的不断深入,其中的关于劳动合同期限、服务期、经济性裁员、劳务派遣、劳动合同的解除等几个方面的相关规定对企业利益的保护也颇具争议。这些规定过度地限制了企业的权利,这不仅有违《劳动合同法》确立的"构建和发展和谐稳定的劳动关系"这一立法目的,而且最终也会影响到劳动者自身的利益。

Abstract:The Labor Contract Law of the People's Republic of China is the law which determines the building of a harmonious society in China,because a majority of people have employment relationship with the enterprises.With the implementation of the Labor Contract Law,the provisions about employment term,service time period,reduction of staff for economic reason,labor dispatching and termination of the contract are controversial.Such provisions restrict the enterprises' rights in excess.That is not only inconsistent...
